    hi .. i've been trying to claim charges and started the ball rolling in november 2008..i've sent off (twice) my financial circumstances evidence (i'm claiming hardship,unemployed,baby etc) and have got these 2 letters back so far.....
    it seems they're stalling and stalling... it basically says "we're looking into it"
    what would you guys suggest i do now? it's a month each time..i can't afford to wait any longer for a response..!!!

    Have any of you guys had any joy with reclaiming £12 credit card charges from cahoot? I have all my stuff ready to print and send but don’t want to get stuck when the pretty much guaranteed reply will be 'that’s what we are allowed to charge so there!'

    Hi All,

    I am new to posting and was wondering if anyone could give me some advice on this--
    My son is a student and has an account with ABBEY. His only income is his EMA grant which is £30/week. On april 2nd he used his cash card and this transaction appeared, on his statement , on April 6th and put his account into an overdraft (according to ABBEY) of 25 pence. However his EMA was also paid into his account on the same day thus putting his account immediately back into "the black". Abbey charged him £25-00 for the so-called overdraft and this charge was taken on 24 May.
    My question is, are they entitled to do this since both the so called overdraft and his EMA grant appeared on his account on the same day.
    I have been told that they are in the wrong doing this but I am not sure and would like any advice anyone can give.

    Very simply, no. In practice, maybe. EMA cannot be taken for anything bank-related, but might take weeks upon weeks to get back, and by then there may be more charges... I used to work for a high street, and that was our (horrible) policy, take and then refund, incurring more charges, to catch the customer in the rigmarole. Look out for that!

    How old is he and what is the type of account he has got?
    I have not worked for NatWest Bank since February 2009

    He is 18 and the charge was put on was his Abbey current account.

    Hello all,

    Started a claim today, i've never gone overdrawn on my account it's my account i get my child benifit paid in to and buy treats and bday pressies for the kids dd bday last month and went over drawn (£100 overdraft) no problem but wrote a check that then went over the overdraft which they honered that cost £35 then charged me £25 more for going over the overdraft which i wouldn't of done if they hadn't of honered it ! and a refused a standing order £15 grand total of £75, guy in the Abbey took off £35 and said to phone call centre to try for more but the girl said that was the wrong info.

    I understand charging but £75 i can see how people spiral in to debt so quickly

    lets see how the letter goes!

    Hi, I received both of these letters followed weeks later by a sorry but it is your problem you went overdrawn (or words to that effect) a few months later I got another saying that as they had an ongoing court case, blah blah, they have been instructed to all customers who are currently putting through official claims for charges to send them a letter saying that the outcome of the court case will determine if I receive any charges blah blah. They want me to close my empty account but it is my understanding that I need to keep it open to claim. Therefore, I understand the court case is ongoing and I am sitting tight. If they do have to reimburse customers (I understand they have monies to do this put aside (claiming more interest for them if they keep it and the court cases go on) they will pay out to the people who are through the process for reclaiming first. I guess after that, they will be swamped. Follow the process set out for that response and keep going.

    I forget where I originally got my letters to start reclaiming from. I am sure it was here and they had other standard letters for every step of the way after that. Your letters are the same stall letters I had. Ridiculous that they are still sending the same stuff in order as they were 2 years ago even though they know they have to take your claim seriously.

    Good luck but dont hold your breath for an immediate windfall.
  • there is not such reason to have a payout, ie that you need to keep the account open,.

    I have a quick question on this. I would hate to imagine just how much I have been charged by Abbey over the past 18 years I've been with them. I realise it's only the last 6 I can claim for and my job for tomorrow is to go through all my old statements - I have them all somewhere.

    So my question is this. I only have the one current account (with Abbey) plus a couple of savings accounts and a mortgage. Can anyone tell me, if I put in a claim with Abbey for bank charges are they likely to close my account - if this is the case would I be better off trying to open another current account with another bank before I write any letters off to anyone?

    Also, I have been trying to read this thread but it's huge, and it's late and I need to go to bed. I can't claim financial hardship as, fortunately, I am still employed. Will I get turned down and told to wait until the court case is settled or is there still a chance I will get something back from them?

    Any answers will be gratefully received. Many thanks
