    You don't have to give the abbey a copy, I done my AC today and asked about giving a copy to the bank & the lady at St Helens County Court said that they contact the bank.

  • Hi everyone,

    I've always intended at some point to dig out all my old statements and try and reclaim the numerous charges Abbey have stung me with.

    A couple of months ago I was short of money when some direct debits were due to go out and subsequently they all got bounced and I was charged for each one. This angered me becuase there was a cheque due to clear into the account the very next day (thx to the fantastic 4 day turnaround banking system) and also because some a couple of the DD's were for less than what they intended to fine me.

    Anyhow I was so incenced I wrote Abbey a letter complaining about this particular incedent.

    After a couple of "we're looking into it" letters I yesterday received a letter going on about the fact that I am unhappy with the bank charges, but they can't do anything until the OFT case is decided etc etc. Basically the letter was several pages long and looked very much like the standard letter they would now send out to anyone going through the re-claiming process.

    At this stage I was complaining about a specific incidence albeit I was going to go the whole hog later. Should I now send a further letter claiming back everything I think they owe me or should the OFT case be awarded in our favour would they automatically refund all my charges now anyway?

    Sorry for the long post and I hope you get the giste of what I'm trying to say.

    Welcome to the club, if you haven't already, you need to get all your statements and go through the reclaim system, you also need to stick to your timescale and don't be put off by the Shabbey with their stalling tactics, I think these are designed to make you get fed up and go away.

    Thx for the response.

    So basically I've got to go through my statements to get a total, the letter they've sent means they would only refund those few charges not be forced to give back everything unless I've actually asked ?

    Yes you need to go through all the statements the bank send you, just look for anything eith CHG against the figure, this is the charge, also, they don't print the charges they are taking on the front of your statements, which they send you. so you have to trawl through all your paperwork. They will only give you back the sum you're asking for, they wont own up to any more.

  • Thx, I think I've got all my statements for the past 6 years here, never throw anything away me :-)

    I'll need to put aside a fair amount of time to trawl through those.

    So it's any charge whatsoever that I can claim for ?
  • Make your claim against Abbey, they should write to you within 8 weeks telling you that their charges are fair & legal but they take customer complaints very seriously :) you will also get all the information concerning the OFT etc. The important bit is that your complaint will be logged & when the test case is over they will look at it again. My claim is at this stage which is very frustrating especially as some of the charges I have had are outrageous. Seems standard Abbey practice for me is to pay a DD & on the occasions where I have not quite had enough in the account (bear in mind I'm on weekly pay which goes directly into the account) they charge £30 for doing so, because they paid the DD I then have an unauthorized overdraught for which they charge me another £20, so I get charged £50 for being £2 short of paying a £35 DD the day before my pay goes in :mad:
  • Yes great isn't it, I've had a £10.00 DD not paid when they could see a cheque for £1500.00 was due to clear the next day and they charged me £30.00 for not paying £10.00.

    It's about time they speeded up cheque clerance as well.

    Also as a retailer it always amazes me that when a customer pays by debit/credit card it takes 4 working days to reach my account.
  • My problem is Im in limbo. In brief I applied for my charges £2500 and received £730 back which like everybody else didn't accept but it was put into our account. Wrote to them and told them wasn't happy with this as a settlement and wanted to take it to 'second stage' waited and waited and you know the rest, constant phone call and letters.... They then wrote back months later to say basicly NO, and then the waiver kicked in. I have wrote back to say still not happy with your decision and I wanted the case to remain open until the OFT had made its final decsion. is anyone in the same position?
