    I got that letter myself yesterday, but enclosed i only got a single statement from August 2001! im on day 50 and still only have my last 12 months of statements. I have been given loads of fobbing off by 3 different people from the abbey, but have to complained to the information commision office and just waiting now!!

    the irony is i CAN'T use the august 2001 statement cos by the time i get the rest of my statements and make my claim, august 2001 will be outside the 6 years.


    Sadly because i know i have a poor credit rating, im praying they dont close my account at the end of all this cos i will struggle to open one else where

    After following Martin's advice with appropriate letters Abbey National offered me £70 for my bank charges when they had taken out over £400! I then sent a further letter stating that this offer was not acceptable and was willing to take a different amount failing that i would take it to court. Now I've received letter stating that they have passed my complaint along and it has now become involved in legal proceedings with the OFFICE OF FAIR TRADING.
    Where shall I go from here guy's do I back out or keep going?:mad:
  • You haven't actually been taken to court by Abbey skinsjenny. What they mean is that the OFT announcement of 27/7 - they'll put your claim on hold until after the OFT ruling.

    I got a statement from Abbey this morning and was annoyed to see charges for unpaid DD and for being overdrawn. I don't have an overdraft with Abbey and decided to call thim as the amount they wanted in charges was £80. This is not the first time this has happened, but it was the first time since last October I have called to see if they would waive any of the charge amounts. After finally getting through I was told it's a matter of Abbey's T's&C's. Unhappy with this I then said why do I get charged when if I don't have the money in my account my card should just be declined. He offered in reply something about a flow amount or something. I didn't pay much attention as I knew this was a scripted reply along with other nonsense. In the end he said they would waive £30. How good of them. I then said I would like all of my statements and or charges going back to when I opened my account with Abbey in 2002. His reply was it would take 8 weeks and I had to pay £10 pounds. Of course he mentioned the test case and was unprepared for my sudden change in questions. Numerous times I have been charged from wehn I have gone over with my overdraft and for when I ahve not had an overdraft also for unpaid direct debits.

    My question is, do I have a case and should I wait the 8 weeks to get the information and have I gone about it via telephone the right way?

    Be prepared to have to object to the likelihood of a Judge ordering a stay on your case, templates are available for this.

    be very carefull with abbey over the phone because they're rubbish, my sister ordered her statements over the phone and waited 40 days. when no statements arrived, she rang them only to be told they had no record of her phonecall, and as they hadnt debited the 10 pounds from her account either. she had no proof and had to start from scratch!

    My advice is to post a letter with a cheque so you will know things are actually happening

    ps. The abbey are giving mis-information...its 40 Calender days, not 40 working days . they said same thing to me, i reported them to the information commision!
  • I have asked for £1300 back from the Abbey - they have given me £500 as a goodwill gesture. I don't want to accept this, however is my case weakened if I use the money. Also I believe I have to wait until the courts (test case) decision before I can further my case.

    I had the same thing happen to me from Abbey, just do what i did. I wrote back to them thanking them for the goodwill gesture, which i accept in part payment of my claim and i will still be claiming the balance!

  • You need to be VERY wary of spending any of this money if you intend to continue with your claim.

    If their offer was conditional (i.e. full and final) then you will have no chance of getting more, but if you reply to the letter and state very clearly that you will only accept it on YOUR conditions, giving them - for instance - 14 days to respond further, then should they not reply it would be acceptable to chase for the remainder and take this payment.

    However, if you want to avoid any doubt, or the possibility of not getting things right, reject the offer and return the cheque, torn in two. Then claim for the full amount...
