Im no expert, but you didnt set a time limit on when you would pursue the rest did you?
The only thing would be if your charge dates go back over 6 years, then the claim will be for less etc.0 -

Wow, well done!I've just had my claim on MCOL acknowledged so now the bank have 28 days to waste more time, what are the chances of people in my situation actually reaching court without the judge/bank requesting the case be stayed?0 -

Hi all,
Haven't been on for a while as was feeling a little dispondant since the OFT annoucement.
As you can see Abbey defended my claim at the 11th hour! So it has now been transferred to my local court, just waiting for a date!
On a brighter note I am also helping my friend claim charges from Abbey with the help of this site. Her claim is for £1900 and Abbey paid £530 into her account last week!:j She has accepted this as partial offer "without prejudice". So at least there is some good news:j

Hi all
I calculated my charges and followed the process to claim them back. Abbey offered me £120 to settle which I declined. Their next letter told me that I was getting nothing ie. they rejected my claim. This was approx 6 weeks ago.
My question is:
Can I still proceed with court action after leaving it six weeks?0 -
I don't see why you shouldn't - if you're in doubt, send them one more letter asking them to reconsider and give them 7 days to respond and if they don't, proceed with the court claim0

Hi
We are in the process of claiming our charges from Abbey.
Now they are getting really snotty with charges, last month I was charged £50 for being £1.21 od. Fair enough, my fault, accept it like a man.
This month, I am being charged £20 for being £1.21 od on the statement date. So basically charged for the same transaction twice. The transaction that took me od was taken out on the 29th June!!!
Spoke to Abbey this morning and because I am reclaiming charges they will not refund/cancel any extra charges...can they do that??
Thanks

Depending on how far through the process you are of reclaiming, you may be able to add them to your current claim.
Abbey can say what they like, but it doesn't mean you can't make a claim for them.0 -
Thanks
I'm at the point on my account were Abbey have sent a letter saying they'll get back to me in 4 wks, then the OFT test case kicked in and I haven't heard anything else.
Do I send another template letter in or just add to the original one?

If this was the initial approach, you can add to the next letter that you have incurred charges since the last communication and you are adding these to your claim.
Bear in mind, Abbey are unlikely to 'investigate' your claim. You can however continue the process and file a court claim. This is likely to be subject to an application to stay and you'll probably have to wait until the outcome of the test case before you know whether you'll get your charges back.0
