Hi suelumsden there is a good letter available to have stays removed on penaltycharges.co.uk. Worth a read. This is what I used for my cases against the SHABBEY. Just hope they work as abbey's delaying tactics have been awful. Also received letters from abbey saying all cases are being stayed, but really hope to prove them wrong!! Keep you all informed.0

morning, i would be interested to learn how to appeal or remove a stay. I agree Abbey are terrible for keeping you waiting. I telephonned them yesterday and apparently they sent me an offer 11th june but i didnt recieve it then because i started court proceedings they withdraw the offer. bizarre i could have done with that as part payment. i'll keep looking on these posts to see about the stay.:rotfl:0

I hope I am doing this correctly - I have never been on a website before!! (I have no idea what a thread is even!!) I recently applied for my bank charges to be reimbursed from Abbey National - £3,750 - and have received a letter from them saying as a gesture of goodwill they will refund £230 (although they only seem to have put £180 into my account). The letter says I have 8 weeks before my file will be closed. Do I have to contact Abbey? Can I touch this money even if I don't agree with the offer? Could you tell me what I should do next.0

Write back to them accepting it as a Part Payment Without Prejudice and give them 14 days to repay the full claim or you will be taking court action to reclaim the full amount.0

1. I received a letter from Abbey yesterday saying they are writing to all the courts asking for all cases to be stayed. What arrogance, who do they think they are! They procrastinate, cheat and steal from us and then shoot letters off to Judges saying they don’t want the cases of how they robbed us heard. This bank has knocked me down, and now they want me to stay there. Well I am getting up again. I will write to the judge as well and tell him I don’t want the case stayed.
I have a court date for September 11<SUP>th</SUP>.

2. Abbey paid a goodwill gesture of £633 to the debt management agency now handling my account in April. A debt entirely made up of charges. Now the agency will not release this money to me until they have received conformation from Abbey that it was they who paid the money in. Nor will they suspend my £10 monthly payments until they receive conformation that Abbey have defended my court claim.
They say Abbey are not bothering answering their emails or letters.

Hi yeovillad, I too got that letter, I think it must be a bog standard one that they send out to everyone, I got it yesterday, my court day is Monday, but I am still going to turn up. As you say they are judge jury and executioner in my mind. I have been told only the judge can stay a case, not Abbey just because they would like it to be that way, and it left me confused about should I/shouldnt I turn up.
My advice to you is dont accept the 65%. Accept it as part payment and still go on for the rest, there are some great templates and advice on here to find out how you do that. I have not been offered a bean, even though I wrote to them and said I would accept £700 rather than the full £1077. They didnt even have the courtesy to acknowledge the letter. So Hey Ho, off to Plymouth Court I go on Monday, Im nervous but steaming. You go mate, get the lot out of them, they have caused you stress through getting into debt, and no doubt you have ended up with a bad credit rating. I got charged 11 times in one month, even though I told them I had new job and would not be paid for 6 weeks. Hang on in there.0 -
Good Luck on Monday suelumsden and let us all know how you got on. Although Abbey have filed a defence against me I have not heard anything from the court and today I also received one of their standard letters about the test case.

Been away on holiday & heard about the court case with the banks. I also received their letter today stating that they were asking for a stay on both my case & my wife's case, I only wish they had been so quick in refunding the cash back. Should I continue to get my court bundle ready or wait until the test case has been hard. Also is it true that only the judge can place a stay on the case.
