    thats bad news at least the court sent me a letter saying it was stayed prior to the date of hearing so as not to waste my time,hearing was meant to be at 13.45 today.
    i would still advise you to submit the form off penaltycharges.co.uk appealing against the stay,you never know the oft and courts service might reconsider if they keep recieving them.
    the banks are probably hoping people claiming or considering claiming will just get fed up and not bother.
    i am going to be appealing against it at weston super mare county court so if i get a response i will post on here what they say
  • It was only stayed today, the barrister met with the Judge before hand.

    in that case i can see a lot more people turning up to court as you did and getting the bad news there and then.

    it seems to me there needs to be some parity with the courts either stay all cases pending individuals appealing it or just allow the cases to proceed as they have been doing prior to the oft announcement.

    Hi All,
    Does anyone out there know whether St Helens (Near Liverpool) courts are allowing the stays to go ahead? I have had my case transferred there and would like to get ahead of the game and send in the letter from the penalty charges web site asking for the stay to be lifted, I have modified it to suit my requirements, just need to know if I jump the gun or wait to hear from the court, any help or suggestions would be appreciated.

  • I'm feeling a bit sick now. Gone through the whole process of writting letters, going through claim online (paying £125) and now in process of taking Abbey to court. 1 week before the OFT announcement Abbey wrote to me offering £1,500 to settle a claim. I wrote to them declining this offer as they owe me £2,500 and now gutted. Can I call the bank at this stage and accept the offer or is it too late???:confused:

    johnnyroper I am in weston-super-mare as well. My court date is for sept 10th. But so far the court has not written to me. Is it worth getting my court bundle together then? And should I prepare an objection to a stay? I think I will telephone the court tommorrow.

    Suelumsden I am really upset for you. I don't think the establishment is going to let the banks loose. I think we are on a hiding to nothing now.
  • Hello every one, over the past 6 years i have received charges worth over £7,000! from abbey, i asked for a refund of the charges. i received a letter from them on the 10th of august and they offered me £750.00!!! they said they had not made a mistake and the charges were correct, that as a gesture of goodwill they would offer me that amount!!!

    so with all that is going on with the oft should i accept this or stick it out and write them a letter saying i do not accept and will take the matter further to court?

    i could really do with some advice!

    2 options mate..

    Tell them you accept it as part payment & without prejudice only & will continue your claim via the courts (MCOL)

    or

    Dont bother with the court bit & wait it out, again only accepting on the same terms as above. Chances are with this you wont get as much as via courts

    You could try give them a ring & see what they say or just sit it out & see what happens with your MCOL. First thing is give them a ring.
