  • GOOD LUCK in court monday suelumsden. Hope you get full pay out. I have also had the letters from abbey saying they will apply for a stay in all ongoing cases! They even advised that "if they lost the high court case I probably would not get more than their 65% offer". Enough to make your blood boil!!

    Let us know when you win and no doubt Shabbey will not make an appearance! GOOD LUCK.

    Received a letter from Abbey saying that they are going to settle my claim in full.

    Court date was set for September. They said they will settle the claim in full, including interest and court fees... All transferred into my account...! Sweet...

    All they said was I need to contact the court and tell them to cancel the claim.

    Anyone else had this?
  • No, wish I had, Im nervous as I dont know what. Well done you, wonder why they settle with some and not with others? Its really eleventh hour for me, I want everyone to send positive thoughts to me on Monday at around 2.15pm if you all can.

    morning harrybaby, thanks for your reply. was you sent an allocation questionaire by your court. cos i have been and its another £100. And how much if you dont mind me asking was the fee for the appeal of the stay.:rotfl:

  • On 21st July Abbey wrote to me saying they would settle my claim out of court and they would either transfer the money into my account or send me a cheque. I sent the settlement forms to the court recorded delivery on 28th July. Because of the strike palaver, the online tracker kept saying it wasn't delivered, but I spoke to the court and they confirmed they'd got my forms. I left several messages for "Ronan Coyle" at Abbey asking him to ring me, because with the postal strikes I wanted to confirm verbally that I had closed the claim, but he's never bothered his !!!! to phone me back. On Monday I got a "you weren't in to sign for the letter" card so this morning I went down to the sorting office to collect it. The letter is dated 27th July and it says

    We refer to our letter to you confirming the settlement of this matter. Enclosed is a cheque for the sum of £667.66 representing the full and final settlement of the above-mentioned claim. We cofirm that this payment is without any admission of legal liability to Abbey.

    Can you please now write to the Court to withdraw your claim and provide to us a copy of your letter.

    And yes, there is a cheque enclosed. Except it's payable to Kirsty Surname and my name is Kirsten Surname. So I have a cheque made out to the wrong name, and a demand that I get a letter to the court and the bank closing the claim by Tuesday!

    I have been claiming my charges back from abbey, i am upto the stage where now there 14 days are up and then i can issue court procedings .

    the only letter i have had back off them regarding anything to do with my claim is the actual statements , i received one other letter thanking me for my complaint , what this was i have no idea
    Not one time have i been contacted even though i sent all the other letters and a letter to accept a lower amount.
    So no responses and there time is up do i go forward with my claim in the courts ? because £120 to take it court seems alot and if theres no point i would rather save this money .

    I have been watching the site for a while now and feel totally walked all over by the bank and the regulatory bodies that are supposed to protect us .
    abbey have done nothing to respond dragged there heels and just made the rules up as they go along.
    they are also adding new charges to my account , they were taking £250 a month in charges from me coz of there catch 22 situation they put you in ie taking all your money and then charging you again 2 days later ...

    Can anyone give me any advice on what to do because it seems they can do what the hell they like and we get to do nothing.
    thought i would ask here as it seems nothing is being done on either side on the bank charges front lately.

    On a further note what point exactly are people and the courts etc upto, seems news on this issue has ground to halt now yet again as the banks are just getting everything they want it really does take the !!!! .

    What you should do depends on how far back the charges go if they are less than six years and you can wait then hold fire and see what the High Court says if they are nearly six years old then you should seriously consider issuing proceedings to protect your position.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
  • Thanks Stokey, and like you say they are nearly six years...
    And i forgot to mention they have taken money from my benefits when i was on them for a short time about 4 years ago, i only got to this stage because they all of a sudden let someone spend over £500 paying for there house, car and AA cover on my card , which i never recieved any notification of what happend and or an explanation, even though all 3 things were with the AA .. its a joke they just do what the bleeding hell they like and its got to stop in my opinion .


    So ofcourse the banks are going to bull !!!! over all that as well with this test case being dragged out for the next 3 years , like they have with everyone already not sending stuff and just ignoring you .

    well maybe 5 years coz we all know how they have all clubbed together behind everyones backs with the 2 regulators and in my opinon already sorted what they will and wont do, with the right amounts of cash being placed in the right peoples bank accounts ...
