So if Abbey don't respond within the 4 wks that 'they' say they will, I can still progress to the next level?
Both other accounts (joint and wife's) have received letters back saying the usual 'make sure you have enough money, we have been generous in the past blah blah blah blah', but on my acc. I've only had the we'll look into it and get back to you one.0 -
Hi i am new to this forum, i have been going through the reclaiming procedure,
and have just recieved a letter from abbey saying they are defending the claim. i also had a note on moneyclaim that they can no longer help as abbey have defended.
Can anyone tell me/advise on what i do next or what happens next?
Moneyclaim also said i would be informed as to which court it would go to.

I have been trying to reclaim my bank charges from Abbey for the last 5 months, I have now subitted a claim through the the Small Claims court.
Abbey have acknowledge my claim and have responded to the courts. They have also submitted there denfense and seem to be going all the way to the courts with this claim..
With the recent announcements I do not know where I stand ie will it still going proced to court or will it be suspended until the test case's have been heard.
I am experiencing extreme fianancial difficulties, ie mortage repayments, utility bills, council tax. Therefore I need my case to be heard or dealt with ASAP, I can not wait until the test case's are dealt with.
What can I do ?0 -
I have heard that most banks do take it to court but end up paying up just before the hearing.
I'm not sure if this is the case and someone can put you right if I'm wrong. they might just be trying to put the frightners on you and are hoping you will pull out first.

All court cases will be going ahead unless you hear different from your local court and so you should be preparing for attending court and you will be notified what you need to take to court and/or what kind of hearing it will be.0

morning rawflava, my case is at the same place as yours and i telephonned abbey and they said all claims will be stayed. i also phoned my local court in ashford and they have stayed all cases too. like you iam struggling with all household bills and i told abbey that they said 'they haven't been briefed on hardship cases yet' I will have such a bad credit rating by the time we hopefully get paid out but ha ho no ones budging. I thought they would continue with cases that had gone this far...but not in my case. good luck.0

I am on holiday at the moment but have been told from home that Abbey have put in a defence to the court for my claim. Can anyone advise me what I need to do next or will the court write to me and tell me.

I believe you will hear from your local court soon.
Abbey defended my claim on 01/08. I have just had a letter from my local court this morning saying,
" IT IS ORDERED THAT
1. The claim be stayed with immediate effect pending the ultimate determination of the Commercial Court litigation.
2. Permission to lift the stay . Any application shall (i) be made on notice to all parties, (ii) include reasons why this claim should proceed before the ultimate determination of the Commercial Court Litigation and (iii) shall be reserved to the Designated Civil Judge ( unless specifically released by him).
3. Unless the court has given directions in the meantime, the defendant shall upon notice to the claimant apply for directions within 3 months of the ultimate determination of the Commercial Court litigation.
There was also a long letter attached explaining why and it said " David Steele J has been assigned to handle the Commercial Court litigation and, on 30 July at a case management conference, he issued directions with a tight timetable with a view to the issues being tried in January/February 2008".:mad: Abbey charges-£4979 case stayed 07/08:mad:Abbey £800 refunded for hardship:beer::jMEAF from Bristol & West -£75 reclaimed 20/07:jNat West Charges-£1169 1st letter sent 19/07Barclaycard charges- £163.20:j0 -
The letter from the courts was dated 07/08/07.
I also received a letter from Abbey this morning saying that they are asking all County Courts to stay all cases pending the outcome of the test case!!!!!!!!!!!!
So looks like the courts have already done it for them!
Just hope this test case doesn't drag on.
