    hi ive claiming £2857.00 from abbey and they offered me £280.00 in which i have refused. then the test case came in to effect and eyerfng was put on hold. ive just looked at my statement and they have put £280.00 in my account. wot shud i do.
  • I was told that if your bank (in my case Abbey) had not applied for a stay within 14 days of the Notice of Hearing (in my case 6th June 2007) they had to do it on the day you are due in court at the actual hearing. Hope this helps.

    Couple of thoughts. I felt that as the judge was definitely on the banks side, what did I pay the £80 court cost for, surely I was entitled to have my say, which I wasnt.

    Also, if other people are still getting payouts/judgements in their favour isnt this discrimination?

    And does anyone think I should appeal against the stay? or will this just make the Judge angry because he told me it wouldnt do any good.

    Suelumsden I am really upset for you. I don't think the establishment is going to let the banks loose. I think we are on a hiding to nothing now.

    from what the letter from the court says it appears weston super mare have decided to stay all cases.

    i would advise doing the court bundle still and get it sent in to the court,so if and when cases are heard again there is nothing to hold it up.

    i would give the court a ring and confirm your case has been put on hold,if it has get the letter off penaltycharges.co.uk and appeal against the stay,you have got nothing to lose

    my sentiments exactly you payed your money so should be able to have your say,after all it was you who started the process not the bank.
  • hi ive recently sent off for my abbey bank statements an only recieved a years not the full 6 i asked for, there was no letter informing me that the rest will follow. is this normal ??? how do i go bout getting the rest :(
  • yes this is normal, the Abbey will mess you about something cronic, they will eventually send you the statements, I got charged twice for them, then they will send you letter after 4 weeks of you writing saying its taking longer than they thought to investigate, then another one after another 4 weeks and so on. Be prepared to dig your heels in lbarnes80. good luck!

    Just phoned Abbey to see why I still haven't received my statements after 3 months and countless excuses over the phone. Was told I couldn't claim back as I had closed the account - when I said it had nothing to do with it and was only asking for statements that I was legally entitled to regardless of the state of my account she hung up on me ( OK it was starting to go to the heated stage as she just wasn't listening!). Have just tried phoning back several times and been hung up on straight away before it being answered!

    I admit I shouldn't have got annoyed but they are just mucking me about and she was so condesending.

    Can I report them for not sending me the statements?

    in that case i can see a lot more people turning up to court as you did and getting the bad news there and then.


    After reading the latest, that's what I'm expecting at 10am tomorrow in Hertford :(

    Hi All,

    After a long 6 months of claiming my court date is finally here Tomorrow at 10am and I'm Sh***ing myself to put it mildly!!!!

    Have had no offers at all from Abbey just a Goodwill £140 out of my £2777 claim + £220 court costs.

    I've had the latest 'Your Court Case Will be Stayed' letter but when i've just rang the court, Abbey have not applied for this yet - the lady on the phone said they can do this tomorrow but it will be up to the judge if he/she accepts this or not.

    As I'm 7 months pregnant I don't want this to drag on anymore and want it sorted, doesn't look like this will happen though.

    Abbey have also just sent me a letter saying they are removing my £500 overdraft on September 1st - I wonder if this warrants a Stay too!! lol as i don't have a spare £500.

    Positive thoughts for tomorrow please!!:cool: and i'll let you all know how I get on!!
