    Well my claim has been 'stayed' until March 1st 2008.

    Such pleasant young lad sent to defend. Came over, sat next to me, explained everything I was aware of through the press and this website, I politely nodded and listened in case he had anything different to say. Then he finished explaining the request for a 'stay', and asked me, do I have any reasons why I might oppose such a request.

    I was a little wary and unsure so I said (exactly these words) "uh, I'm not sure whether I should be discussing this with you".

    I have never seen a conversation end so quickly in my life and the lad must have had wings to get back to his seat so quick....

    On my way out of the building I picked up the N244 form just in case I decide it's worth pushing forward now instead of waiting until next year.

  • Appeal, Im going to, its worth a go isnt it, we pay the court costs and now no one wants to listen to our arguments. Did they actually say the case was stayed until March 1st 2008, only I was told 2 years.

    The judge took the time to explain what the courts were planning to do re: the 'stays', said that a judgement was due on the OFT case in January and the the courts would process any 'stayed' cases after that. I wasn't sure about the short amount of time he was talking about compared to the 1-2 years assumed but I wasn't about to start correcting a judge on details I wasn't 100% of myself :silenced:

    He then said he was 'staying' my case until March 1st. Actually I don't recall him specifically mentioning 2008 to be honest so he could have meant 2009 lol.

    Does anyone know if we get anything regarding the decision in writing from the court? I assumed I would get these details in writing a week or so later.

    I have recently received a letter saying that my case has been transfered to my local court although due to the test case all cases are on hold. I didn't for one minute think i would have to go to court, i suppose i thought i would get abbey to pay up before hand, my question is; should i chuck the towel in? I don't think anyone stands a chance now do they? I don't want to stand up in court, i wouldn't have a clue what to say, i would probably have a panic attack and collapse on the floor!!

    Hi Daphne,
    Don't despair kid, I think we're just going to have to wait a little longer to recoup our money from the Shabbey. Just think, you can keep on adding daily interest to the cash they already owe you. Keep your chin up, and don't give up that's what the b*stards want us all to do ;)

    hi im in the same situation as you they put £200 into my account instead of the full amount of £4,900. I have replied to them with a letter refusing it as full payment and accepting it as part payment of the full amount i have also told them by phone call im now waiting for a reply from them, and they dont believe in rushing them selves:mad:

    At the risk of appearing stupid, what exactly is a 'stay', why are the banks doing this (is interest frozen on outstanding overdraughts when the claimant begins legal action) and how does it affect new claimants? We have just received the 'goodwill' letter form Abbey and was about to send the template letter threatening court, but have the goalposts now moved?

    edit: just read martin's update so answered my own questions, apart from account status during the 'stay' I take it it WILL be frozen??

    I'm claiming for £2700 from abbey and they offered as a gesture of goodwill £140. I phonned them and said i didn't want the money as i was taking them to court and the man said no its a gesture of good will so it would go in regardless. i continued with my claim through the court which is obviously now stayed.

    basically it means the case has been put on hold pending the outcome of the test case between the oft and the banks.
    it does not affect new claimants any different to existing claimants it just means at the court stage it will be put on hold.
    so my advice is to continue through the process and submit it to the court and then just wait for the test case to finish
  • I have just received a Notice of Transfer of Proceedings informing me that the claim has been transferred to Barnet County Court. Has anyone any experience of Barnet. I have not been told that the cases are being stayed there too. Or is it a blanket stay now?
    Also has anyone recently been to court say in the last month? Please reply.
