It seems rather unfair to me that the £35 was put into his account let alone offered.He sent his claim to Abbey over 2 months ago, received one letter saying they were dealing with it about 5 weeks ago.I had the feeling they were hesitating and had some knowledge that something was about to change!
Should he;
a) send a cheque of £35 back to them so that he does not accept their offer?
b) carry on with his claim and await the outcome of the courts?.

I accepted the partial payment from Abbey on Friday, without predjudice of course over the phone, and was told to put it in writing but due to the FSA waiver thingy blah blah blah i would be like thousand sof other claimants and have to wait on the results of the test case, however happy with the money at th moment considering it arrived on the day of the announcement. :mad: :mad: My son received a letter from Lloyds solicitors, saying that without predjudice they had been instructed to enter into negotiations over reimbursement of charges (They required some additional information) this was supplied approximatel 15 days ago - however he has head nothing since.
Can we assume that this has now been put on hold along with all the others? Or should we write for clarification?Jayne0 -

can anyone pls over me a little advice, i have been trying to claim back £1600 in bank charges (was prepared to accept a reasonable offer) abbey have written to me to offer me £175 as a goodwill gesture! (wheres the goodwill gestures when they are slapping on these charges!)
Can anyone please let me know how to word a letter telling them politley that their offer is a joke and i want the full amount, and how this new procedure they are going through will impact!
any guidance will be gratefully received!0 -

Something along the lines of 'Thank you for your offer of...although I feel it is too small a gesture, I will be refusing and persuing the full amount via the county court, as none of the cases in the small claims system are currently on hold. If you would like to reconsider your offer, I would be happy to accept no less than 100% and consider the matter closed. Your sincerely....'
...something like that. I find there is no real template when negociating with the banks on this matter. Just go for as much as you can and don't back down until you have an offer you're happy with. Also, stick to all your own time scales, shows them you're serious.
You might be aware that cases in the small claims system are still going ahead, so once in the system, it'll take awhile, but you will get through, probably before the test case goes to the High Court. The banks think they've been clever in getting all the OFT cases suspended while the test case goes ahead. It will save them time and money (HSBC reported payouts of 116 million in the Independant on Tuesday), the small claims system is still an open road, so you have options.
