    I started to reclaim my charges from Abbey earlier this year and got to the stage where they offered me about £700 from the £1900 reclaimed. I wrote refusing this but they paid it anyway. I wrote again saying that I did not accept the payment as full and final and wanted the balance and was about to lodge a court claim.

    At the same time they started to try and reclaim my overdraft from me and the overdraft is entirely made up of the balance of the charges that I was trying to reclaim from them.

    We are now in a position where I have responded to their repeated requests for payment of this overdraft by stating that the overdraft is entirely composed of illegal charges and if they take me to court I shall enter a defence and counter claim that the sum claimed is based on illegal charges, alternatively I would continue my original claim (which with statutory interest and charges will be a little more than they are claiming from me) in court and then use the money to pay the overdraft.

    I have twice offered to withdraw my claim if they withdraw theirs and cancel the overdraft but these offers have not been accepted and I am waiting for their next move.

    Are Abbey likely to pursue the case against me or will it fall within the cases put on hold? If they do go ahead can I use the defence that they are illegal charges and counter claim? What should I do?
  • I have been given a date for court for Abbey. Will I have to go or will it be postponed/cancelled because of the OFT announcment? I've read all the pages about the announcment but it's not clear what will happen if I've already been given a court date.

    If the court does not tell you that it will be stayed then it should go ahead. Phone the court to be on the safe side.

    Hi Martinp,
    I too have been trying to get my details from Abbey since February! Have now contacted Financial Ombudsman, who is still able to chase up SAR requests. Like you, I'm furious that they have delayed this long, and hope that they will be held accountable for their flagrant disregard of the Data Protection act... Time will tell!

    I am trying to reclaim from the abbey. I have my second letter with list of charges and interest but when I took it to the branch, they would not accept it saying they are no longer dealing with reclaims. They said I would need to phone in for an address to post it to when I phoned thier overseas contact centre I was transferred for over 20 minutes back and forth then told it needed to be posted to my local branch.
    Does anyone have a name and/or address to send it to, like a customer liason officer at a head ofice or should I be going to my branch.

    any advice would be appreciated

    They Have Entered Defenses And I'm Waiting For A Court Date And Or An Offer From Abbey.
    Will My Cases Be Put On Hold?

    Had a look at Martin's update, couldntfind anything specific, so here goes..

    My claim was acknowledged by The Abbey today on MCOL's site, i know they now have 28 days to respond (buying more time), so anyone know whats likely to happen now?
  • My husband has had a payment of £35 put into his account by Abbey before he received a letter from them stating that was all they were prepared to repay. He had two accounts with them and the total that he was owed in unfair charges was almost £1,500.00.

    It seems rather unfair to me that the £35 was put into his account let alone offered.He sent his claim to Abbey over 2 months ago, received one letter saying they were dealing with it about 5 weeks ago.I had the feeling they were hesitating and had some knowledge that something was about to change!

    Should he;
    a) send a cheque of £35 back to them so that he does not accept their offer confused-smiley-013.gif ?
    b) carry on with his claim and await the outcome of the courts confused-smiley-013.gif ?.
    I am writing this because my husband is still at work, unlike all the bankers.
  • well,following the sucess of my claim against abbey national for £1700(they paid me out the lot after entering a defence at court)i decided i would take on my partners case with abbey for £1600.i served a summons on july 16th and they have acknowledged it and i have been sitting waiting for an offer.
    then bang! all this about the oft and court cases has come to light and now i dont know whats going on as we are already in court.do i carry on,do i speak to the court,will hmcs contact me about it,will it get suspended??????????????????????????????????????
    does anyone understand this a bit better than me or is it just lack of info at mo? would appreciate any comments kind regards candice
