Any idea of who you spoke to? I have been trying to get through to someone who can just give me what I am owed (was given £180 goodwill gesture back in MAY, and still not seen a penny of it!). Spoke to a chap yesterday, who, yet again, said he would request someone to look into it. Such a great fob off, I kept asking to speak to whoever it was that he was chasing it up with, but all I got was a brick wall. This is stalling tactics, having worked in call centers and customer service departments I know these lines off by heart.
Anyhoo, Financial Ombudsman... I am right in thinking this is the next step yes? As I am not asking them to look into the charges, just the really long wait for my refund, they should take this one on?Cahoot loan - £2000 - Cleared!

Debt Collectors - £3000 - Cleared

Can anyone help? I have been going through several threads but cannot find the answer. Am I right in thinking that if a claim is already with MCOL that this is still ongoing? I issued my claim on 02/07 (so deemed to be served on 07/07), Abbey acknowledged on 10/07. I have heard nothing more, my main question is if i have still heard nothing by 04/08(28 days up) can i still request judgement by default??????????????

Molly, I have also issued via MCOL ages ago, back in April, my court date is on the 13th August, I think the general consensus of opinion is that all cases will be put on hold until the test case has gone through the High Court so its just a waiting game, and I read in the Sunday paper that it could take up to a year.0

Or they may not as it does depend on what your local court decide so Sue, you better continue getting prepared for court!0

Yes you can but be prepared for Abbey to issue a defence at the last minute which will mean your case will be transferred from MCOL to your local court.0 -
Im all prepared Edinburghlass, I have it all in a file, it is making me so mad but Im staying calm. Just one thing, the Abbey have stated in thier defence that 'You can apply for an overdraft on yoru Account. blah blah blah' Well actually I cant, I tried to apply online and it clearly states 'This account does not support an overdraft facility' so in fact Abbey have lied in their defence. Is it worth pointing this out to the judge or will he/she think I am being clever?? My daughter got all her charges back from Barclays with none of this fuss.:mad:0

By the way, I got charged 11 times in one month (a total of £375 for being 57p overdrawn) even though I had gone into the bank told them I had changed jobs and would not be paid for 7 weeks, but they wouldnt budge.0

I would certainly print that out and see if you can find it in their current T&C's for your particular account and take both along.
It could be that the bank will try between now and 13 August to have your case stayed, or indeed on the day but hopefully we'll have the answers to that senario by then.0 -
I hope so because I have asked for the day off work, but I should imagine I will hear what is happening before then.0

hi everyone i sent off the first letter to abbey on march the 2nd i got 1 year's worth back on the 28th of march i popped in to my branch 38 working days later to find out where the rest are coming they said to wait i'm still waiting to this day for the other 5 years please can anyone help me0
