I have my court date as 17th August, a defence has been put in by Abbey, but I have been going since 22nd Feb, it seems to be taking so long compared to other on here, Im a bit worried, I have not been offered anything in settlement even a percentage, any advice or shall I just hang on?0

I am in the middle of claiming £2696.38 from Abbey through MCOL, they have acknowledged and now have until the 2nd August to put in a defence, apart from the usual 'looking into it, need more time' letters I have heard little from them. After reading most of the posts on here I realise that Abbey take it all the way, but I was hoping for a GOGW by now (not that I would accept it, I plan on going all the way with the claim) Do they always offer a gesture or am I jumping the gun???

i started my claim in feb and the only contact i've had from abbey are the
two letters saying they were sorry blah blah blah, and the "we will investigate" letters. and thats it!! i'm now waiting for court on August 14,
but have explained to the court i won't be able to attend as i'm away on holiday, so i'm now waiting to see what the judge says this week!!

i started the whole process back in febuary,i have recieved the usual stalling letters from abbey and a goodwill gesture of £150(my total claim is for £7900).
court date is set for 13th august and i have had no further contact from abbey offering to settle on a percentage.
is this normal for them to not get in touch?
has anyone got a number to ring abbey to discuss the claim and kick off negotiations?

I managed to get through to the legal dept after ringing the Milton Keynes number, they told me to ring 0870 607600.
Then the lady in the legal department gave me this direct dial number
02077564363(seems a long number have not rung it myself yet).

I got a letter yesterday from Abbey stating they won't pay me back as they are within the law and will pay me £105 as a good will gesture, i'm claiming £745, they advised me to go to the Financial Ombudsman if i'm still not happy.
Should i write to the bank once more telling them i accept the part payment without prejudice and want a full refund or just go to the FOS?0 -

I have gone trough Martins process of sending template letters. I am now at the stage where Abbey National have acknowledged the claim, within the 14 days but did nothing else. I was going to give them another 14 days and then request full payment by default. But today I received a letter from Abbey with a copy of the defence that they have filed with the court. They basically try to cover their back in this letter, also saying that they do not agree on the true costs of the charges, or the interests that I have charged on top. As a goodwill gesture they have offered to pay me 65% of what I claimed which i think is a bit of a joke. Had it been the other way around, the bank would have never settled. Where do I go from here? the charges owed to me are in the region on £600. I am not in the mood to accept the partial offer they have given me plus they say that any monies aready refunded to me relating to the charges will be offset against their settlement offer. Basically they want me upon payment to write to the court and withdraw my claim. Im confused and scared I will loose everything if I continue. Should I ignore their letter and wait for the court to get in touch?? I think the next stage would be that I receive an Allocation questionaire. Thanks all!!0 -

Seeing as its just £105 pound i would decline the £105 and go straight to FO and seek full amount. Let the bank know this is what you are doing and then call the FO or dowland the form fill it in ad send it to them they will send youa letter with a ref number to be able to check on prgoress of your case0 -
The only thing is that they actually refunded the £105 about 4/5 weeks ago and they claim they sent a letter out on 9th May, but i never received it, they've sent me a copy now. So i can't refuse the money as it has gone now. So should i write or contact them and say i accept the £105 as part payment and will take if to the FOS if i don't get a full refund0

I, too, have just received a letter from Abbey, stating that they are satisfied that their charges do not contravene the Unfair Terms in Consumer Contracts Regulations 1999. However, they state that, as a goodwill gesture, they are happy to refund £273, (on a claim of £1,614) and state "Your account will be updated within the next ten working days". They also state that if I am unhappy with this, I must lodge a formal complaint with their complaints department, and if, after eight weeks, I am still not happy, I can take my case to the Financial Ombudsman.
My question is does the fact that they are crediting me with £273 invalidate the rest of my claim? What should I do with the £273? Should I send them a cheque, returning the money or what?

From what i have read in another thread you can accept it as part payment but make sure you say you accept it "without prejudice", so the case is not closed and you can still go ahead with whatever route you decide to take,
be it Court or FOS0
