DON'T SETTLE!!
Abbey have just paid out my claim in full!!
I wrote the first template letter claiming £962 plus interest back in April.
They responded with the usual stalling tactics saying it would take 8 weeks for them to look into it. I decided not to bother with that second letter and went straight to the court stage through MCOL. That took my total claim up to £1280.
After two weeks they filed a defence. They wrote to me offering 65% which I rejected. I wrote back saying I would settle for my charges plus the court fee which was £1082. They wrote back rejecting this but offering £920.
I was considering settling for this but then I got a letter from the court saying that the case had been automatically allocated to my local court. A couple of days later I got a letter from Abbey telling me they are settling in full. Actually they are settling for more than I was expecting. They are paying £962 charges plus £198.91 original interest claimed plus £10.58 additional interest worked out by them plus £220 in court fees as they mistakenly believe that I had to pay for the allocation questionaire. Grand total : £1391.49 which has already been credited to my account.
This happened despite them rejecting my offer to settle for £1082 only a couple of weeks ago.
In my oppinion the left hand doesn't know what the right hand is doing. Everything they do comes down to tactics and their policy is to pay out in the end.0 -
Hi, has anybody had any problems claiming their charges from Abbey?
I've claimed my charges but abbey are not very coopretive and say that they have a 8 week policy to deal with complaints.0 -
hi Abby, get some court papers file court actions against them will cost you court fees but you will get them back and take them to court my opinion is don't wait go for it0

I was told on this forum, write the templated letters with the 14 days to respond, and stick to the time for them to respond.
If they don't respond, move to the next step.0 -

Just received my monthly statement from Shabbey, this month they have decided to take charges totalling £255, one of which is £30 for a unpaid DD for the prncely sum of 1 English pound, since starting the reclaim process in June they have debited my account with almost £500 which will include the above charges. Even !!!!!! turpin wore a b*oody mask. the robbing git's

I wrote to Abbey with the first letter in the process, asking for details of any default charges on 17 April!!!
I've since called them 5 times chasing them up only to be told yesterday by a Manager in 'Customer Services' that they sent me an acknowledgment letter on 20 May but to my previous address!!!! And if I send another letter chasing them up I will be jumped to the front of the queue otherwise I will probably just be kept waiting as they deal with the ones putting pressure on first!
3 months I have now waited and not even a statement in sight!
The problem is that I am told the only way I can contact the 'correspondance department' is by letter...apparently even internally they can only contact them by e-mail.
I'm so frustrated..I want to make sure the letter I send next is worded correctly but I am unsure what to put. I also want to complain about the service but I don't know whether it is a bad idea to mix the 2 up (its same dept that deals with complaints).

Just a bit of an update from me, spoke to abbeys legal dept yesterday to see if their was any update on my claim (currently Abbey have acknowledged my claim and have until 03/08 to submit their defence). I was told by a very helpful lady that I would receive their defence by 26/07 but also that in 70-80% of cases the solicitors will make an offer at this stage which is when I can make a counter offer if I want to.
Waiting to see what they offer now.

just a note to let you know what I went through, just to show that you WILL win!
I did all the prelim as set out in the guide. Requested statements, sent a letter to Abbey claiming the full amount with interest.
They denied everything.
Filed on Moneyclaim,
Got a court allocated.
Sent in my Allocation Questionnaire.
Abbey Filed a Defence.
Abbey sent a letter offering half, I declined.
Was relocated to another court nearer their Head Office.
Got a date for the hearing of last Tuesday.
Rung up Inga at the Abbey to see if she would settle. She offered £1280 out of my claim for £1680, saying that I should have been cherged some sort of fee and that they would argue this. I declined.
I turned up at court for my prelim hearing with about 6 other guys who were doing the Abbey, The Judge wanted to do a job lot.
Result was, we all went in one at a time and were told that the Abbey had not turned up but that they had sent letters out to us all to say they were settling in full. He wrote out a judgement to that effect and said that if they had not paid it all by the 7th of August he would enforce the judgement.
Got my letter yesterday confirming it. The only problem was they had left off the £100 court fee which they reinstated when I called them.
I think they have finally given in, so whatever you do, do not settle for less than the full amount!

Hi, i'm very new to all this! But just found out Abbey have charged me £2100 with interest in bank charges in the last 4 years! I am looking at claiming this back i'm not concerned about them closing my account but will they want me to pay my loan off too?

Could you let me have the number of the legal department for Shabbey, as we're going away on Monday for 2 weeks hols, and will be away when they're due to put a defence in, ours is 1st of August deadline from them, I see we're still on the same track regarding timescale with them.
Make sure you get the amount you want, not what they are trying to fob you off with.
