    I'm going to send this to Abbey as their last chance before i proceed further.
    Is this ok in your opinion? Should i add or remove anything in the letter?


    I refer to default charges applied to my account amounting to £765.39 including interest which I have requested you pay back.
    I refer to your letter dated 16 July 2007 and also 09 May 2007, which i did not receive, you stated you will refund £105 as a gesture of goodwill, which you have done. I will accept the £105 refunded as part payment however i accept it without prejudice leaving £660.39 owing.
    I look forward to a full response to this letter within 14 days, otherwise I will commence court proceedings to reclaim my money.

  • I'm in the process of battling Abbey for over £3000 of charges over 6 years. Last week I got the 'we were right, but we'll offer you a goodwill payment' letter offering £315 - obviously I'm not prepared to settle for this so I sent them back a letter, downloaded from the Govan Law Centre Website telling them that I wasn't happy and that they have 7 days to respond before I go to court. I have just checked my balance and they have added £245 to my account, when I rang them and asked what it was for they said it was for 7 charges at £35 each - when I pointed out that they had offered £315 they said yes but that was to include 2 more charges due to go from the account at the end of the month. What I need to know now is what should I do? I still want to go to court and try for the full amount but by them putting this money into the account I'm worried that they will take this as me accepting their offer - I'd really appreciate any advice on this one, because there is no way I'm happy with their offer and I want to take it as far as I can!!!!!!:j

    Hi all, I do not have the funds to go tho court ! Im in the second faze of the Abbey Complaint Proceedures, Has any one got any money off the Abbey, they have put £280 in my bank 5 days before offering it to me by letter and it went in in £25 slots, they say its a good will offer, I rejected it, if it went in in one lump sum it would have been a good will offer as it went in in 25's as the money came out in 25's does that not seem like admitance of over charging. There 4 week letter is now 10 days late.:j

    I applied for my bank charges over 8 weeks ago. Abbey sent me a letter today offering me a settlement of £815, I have asked for over £4,000 Plus interest. I will be replying and excepting this as part payment. Is there a stencil letter to apply for part payment? Also my debit card run out at the end of June and Abbey still hasn't sent me a new card. This site has been a massive big help for me, without it I wouldn't have known what to do. Thank you all very much. x

    Sounds ok to me, if you look through the help thread alot of people seem to get a partial offer and the important thing is to accept it "without prejudice" and that you will still proceed with your claim for the remaining amount. Also alot of people seem to then get an offer for 65% of their claim.

    Hi need help!

    I have done everything as suggested on this site, letters sent at the right intervals, MCOL and finally court allocations. I have 3 cases all against the abbey all at roughly the same stage. All 3 were sent to different courts although I have requested they are transfered to my nearest court. My biggest claim (£4500approx) was sent to St Albans and today received the following :

    Before DISTRICT JUDGE FIELD :

    IT IS ORDERED THAT :

    1.The claim be stayed as it makes no serious attempt to comply with
    CPR 16.4(1) by setting out a concise statement of the facts.
    (Stylised particulars do not constitute compliance.) The Claimant must
    amend or substitute the particulars of claim by setting out the case and
    by including details of the charges complained of, how they are calculated
    and in what circumstances they were incurred.

    The Claimant should note that sending copy correspondence and/or copies
    of bank statements will not suffice.
    The Claimant has until 4th August 2007 to comply with this order.
    In default the claim be struck out without further notice.

    2. The Claimant is to pay the allocation fee by 4pm on 27th july 2007 and
    in default the claim shall stand struck out without further order.

    ANY SUGGESTIONS OR HELP WILL BE APPRECIATED.

    They are alledging that you havent documented your case sufficently, and if you dont improve it then they'll move to have it thrown out

    You must fully document your case, i'e on a plate for Mr Judge to read, so - spread sheet of dates, charges, interest claimed to date, reasons given for charge and reason why (in each case) you dont feel it should be charged.

    You dont say who sent it, but it sounds like its from the courts?

    I've in the process of compiling mine now - was looking for info on which bit of the Unfair terms in the consumer contracts reg's... anyone help me out with a ref or quote?

    Hi I've sent off the initial letters to Abbey and they replied requesting four weeks to investigate. They sent me anither letter on Friday requesting another four weeks which I won't do but before I send off the next letter on the list, they are still applying charges to my account. Can I include these charges in the next letter ie: "blah,blah,blah...I am also including charges to made to my account in August of £xx.xx bringing the total of my claim to £xxx.xx? Would that be ok?

    Hi Everyone

    Thankfully one all my bank charges back :j but now a bit worried as they have said i could have overdraft in which ive never been offered before, im just a bit worried as to why they would do this, anyone else had this with abbey ?

  • I have followed the template letters on the website and sent them to abbey national requesting my 6 years worth of statements, the cheque was cahsed on the 7th June 2007n and i received a letter over the weekend informing me that i am not able to continue as "i was provided with the information detailing the terms and conditions when opening the account", and that they "have carried out a full investigation for you" is this correct and if not where do i go from here, there is nothing in the letter about refunding my £10!!
    I did raise this complaint over and email, and then send the letter requesting the 6 months bank statemnets which are due to reach me by the end of July, do I hang fire in case they are being dealt with separately?
