    Hi Ive been trying to claim my charges with Abbey which total up to £2523!
    Sent them the first letter and they replied by saying they were dealing with my case and will be in touch shortly! so i waited (stupid now i think i should have just got on and sent the court letter)
    Anyway recieved a letter saying they have carried out a full investigation, as a gesture they have offered to pay me £90!!!!!!!
    and if i remain unhappy with the responce i have the right to refer to the FOS!
    What do i do know? do i send a court letter, or go straight to the FOS?

    Please help!:confused:

    I'm taking Abbey on as well. I've just this second, filled in my online claim with the courts, using Money Claim Online. Abbey have used delaying tactics all the way & haven't even responded to my 3rd letter where I threatened to take them to court.

    Keep going with it & follow Martin's instructions to the letter.

    Abbey appear to be the slowest to pay out from what i have read on here.
    If you have sent the 3rd letter then the next course of action is the courts or the financial ombudsman, might be worth you phoning abbey beforehand because that has worked for some

    Hi, received a letter back from Abbey offering me £785, which is under a third of the total amount i'm claiming back from them, does anyone have a template letter for declining this amount?, Ive had a look through this most of this thread and havent come across one yet. (Dont want to word it wrong when i respond to them).

    Hi can anyone advise me as to whether to send yet another letter saying I will take them to court because the last letter I sent last week they replied by saying they will look into it AGAIN - in other words the whole same process again that I have been through - Please advise - thank you :confused:

    If the bank haven't stuck to your timescales then it's time to carry out your threat. Commence the court claim.

    If you let them 'look into it' further, they could string you along for months.

    The so called "goodwill gesture" in a way is admitting they are in the wrong.
    They are there to make money and i don't think they would give money away....(except when a hole in the wall goes banana's):cheesy:

    After my initial letter claiming over £800 they paid me £270 as a goodwill gesture. I accepted that as partial payment and submitted a small claim in May. My court date is August 14th and today I have a had a letter advising me they are willing to settle out of court for the full amount due - £619.53 including fees.

    Thank you very much to everyone on this site who has helped me with this. I will make a charitable donation from the refunded money.

    Since this looks like the best place to post this, i may as well do so.

    Abbey have plans on taking a test case through the courts within the next 4-8 weeks. I know this because i have worked with the legal team preparing the case.

    The division i work in receives around 1500 charge letters a week and it actually costs the company more to reply to all these letters (within 5 days as an FSA rule) than it would to instantly refund all the customers.

    I don't know what the ruling will be, but i do know that Santander are throwing all the weight of the legal team behind it. Thought you might like to know
