  • Hi everyone,

Am new to this forum and am hoping someone out there with all your experience can help me. I wrote to Abbey back in April who after 10 weeks wrote and told me GO AWAY basically. So I wrote to them and gave them 14 days or I would take them to court. The 14 days are up today so I am about to start a claim on Money Claim Online.......I have asked Abbey for a Head Office address but was told they don't have one. Do I make the claim against my branch.?? Any tips before I take them to court :( would be much appreciated. Thanks Lorna

As long as you're clear you will accept this only as a partial settlement, you can continue to claim the rest.

Be careful about spending any as the banks have been known to take back offers if you don't accept them as full settlement.

I'm going to send this to Abbey as their last chance before i proceed further.
Is this ok in your opinion? Should i add or remove anything in the letter?

I refer to default charges applied to my account amounting to £765.39 including interest which I have requested you pay back.
I refer to your letter dated 16 July 2007 and also 09 May 2007, which i did not receive, you stated you will refund £105 as a gesture of goodwill, which you have done. I will accept the £105 refunded as part payment however i accept it without prejudice leaving £660.39 owing.
I look forward to a full response to this letter within 14 days, otherwise I will commence court proceedings to reclaim my money.

    Yours faithfully

One more question before i send it off, should i hand it into my branch or send to the senior customer resolution manager in Milton Keynes(who sent last letter to me)

    Thanks

Hi, I completed my MCOL against the Abbey last week and it was served last Monday, I sent all letters to my local branch and also put the local bank address down on the MCOL form.

When i sent my list of charges in a spreadsheet off to Abbey i didnt include the actual reason for any of the charges, Does the reason have to be in there too, and if so do i just wait for them to contact me to amend the detail?

 I have sent the original template letter addressed to the Data protection address that the website provided and received a letter detailing a full investigation which would take about 4 weeks - 4-5 weeks later I received another letter explaining that they were right to charge and the investigation basically proved nothing - they still said "no can do" - I then sent the 2nd template letter asking for the money plus interest etc with the next 14 days requiring a response. I then received another letter from them 3rd July not 14 days later saying that they have carried out a full investigation on my behalf and still say "no can do" - I then sent the next letter threatening court action - but I think I made a mistake by sending it to the address on the last letter which was : customer complaints dept at the same address in Milton Keynes because I then received the exact same letter that I received in the very beginning which came from the Data protection dept. - HELP - have I messed things up - PLEASE let me know what to do next?????
