    Morning Mollymalone,
Could you let me have the number of the legal department for Shabbey, as we're going away on Monday for 2 weeks hols, and will be away when they're due to put a defence in, ours is 1st of August deadline from them, I see we're still on the same track regarding timescale with them.
Make sure you get the amount you want, not what they are trying to fob you off with.

I received the defence while I was away and was worried about it as my judgement was declined when I checked. It was a worry, but received Abbey's defence. Looking to negotiate and settle at 80%.

What papers are needed to take to court? Statements etc?

    Regards

    Martz

will they want me to pay my loan off too?

    Please help!! Thanks :o

I'm no expert but I'm sure they cant insist upon it. A loan is just another form of an account and not related to your bank account hence the different number. Also, when you get a loan, you sign up for a repayment term, 1 year, 2 years, 3 etc. That agreement will almost certainly dissallow the bank from recalling the debt providing that all repayments are up to date and being made within the terms of the agreement.

Dont worry about it IIWY. Go for your charges and give them some payback. You might even be able to pay off your loan with the banks money ;)
  • Thank you :o

  • "Bare with me with this one, its increasingly strange! My claim began in Feb asking Shabbey for statements (account closed 2004) didn't receive them until May and also got my £10 because it took them so long. Claim put in May, standard letter sent back to me, 2nd letter sent after 2 weeks, reply from Richard Harris saying charges just and fair, no refund forthcoming blah, blah, blah! I wrote again giving them the opportunity to repay 85% and if not I would take the matter to Financial Ombudsman. On Thursday receved two letters from Abbey (Richard Harris), both dated 10th July, one said "sorry for the delay sorry its taken longer than eight weeks you can take it to FO if not happy but we will be in touch after review", the second said "we are conducting an investigation". Today (saturday) I received a letter from Mrs Jennie Herbert dated 6th July, apologising for the delay in sending statements advising me these have now been reordered (received them in May??) and will be with me shortly, this is the paragraph that puzzles me and I would appreciate any advice;

"As there has been a delay in you receiving this information, I've arranged to send you a cheque to the value of £40.00. This refunds the £10.00 fee you paid for this service and the remaining £30.00 is to cover any incidental costs you may have incurred. This is in full and final settlement of your complaint and the cheque will be issued within the next seven to ten working days."

Now does this apply to a complaint (which I haven't made) re late statements or to my claim for charges. I think its just about the statements but I would appreciate your opinions and advice."

And now the plot thickens have received a cheque for £40 in full and final settlement and also a letter to say they won't send out statements because our address is different to the address they have registered, doh - received statements back in May already had the £10 refunded and now a further £10 plus £30 for the inconvenience. Also my one complaint now has two reference numbers ... me thinks the Shabbey don't have a clue what they are doing!!

  • I am trying to claim back nearly £3000 of bank charges from the Abbey,
they sent me a letter yesturday saying they will offer me £530 as a goodwill gesture, and that it will be credited to my account within 10 days.
I dont want to accept this and have just printed the forms to take it to the ombusman. do i have to inform them in writting that i dont want to accept their offer or can i call them. Im confused!!!!
  • You could phone them to raise the offer or just write to them that the offer is unsatisfactory and you will proceed to take them to court. Good Luck
  • Oh the ombusman may take longer as it states in the info on the web site. :)

    Sorry Martz,
I didn't read your post properly before, if you go to the court bundle thread, you will find everything you need to take into court, all the paperwork is there to put together your defence, including witness statements, (which pertain to you as the witness) and all the other stuff, don't print it off too soon because there is an awful lot of printing to be done & then you have to have 3 copies, 1 for Shabbey, 1 for court & 1 for yourself. but that is all explained if you read the court bundle thread carefully. I'm sure that the helpful people on this site will also offer all the assistance you need.

    Good Luck, Sparky
