As I said earlier I recieved a letter on Saturday offering me the standard 65%GOGW which was £1546.50 from a claim of £2379.21.
I rang one of the numbers on the letter and got through to Ronan Coyle, abd told him that I was unable to accept the offer and that I was sending him a letter to confirm my decision.
He asked me if I would like to make a counter offer, and I explained to him that if he could tell me exactly how much it cost Abbey then I would happily ammend my claim to reflect that, if he copuld not tell me then I would only settle for the whole ammount.
He was a little blunt (although not rude) and told me to go ahead and send the letter.
Here is a copy of the letter I sent which I drafted from a couple of letters I had read on this forum.

Thank you for your letter dated 12<SUP>th</SUP> July 2007 with respect to my claiming back of bank charges made to my account over the last six years.
With regards to your offer of £1546.50 in full and final settlement of my claim, I would like to inform you that I am not willing to accept this offer.
You infer that I am of the belief that I should not have to pay any charges at all. This is completely untrue. What I am objecting to is the way your charges are totally disproportionate to the cost of the breach on my part, and therefore unlawful. If you could reveal to me, in writing, exactly how much it costs for a breach and an automated letter to be sent, I would happily pay this amount. For me to be charged a total of £50+ for such a breach is something which I regard to be disproportionate, and there are many other examples of this, as previously enclosed to Abbey since raising my complaint.<o:p></o:p>

The only possible way you can legally defend yourselves against any part of this claim is to provide me with a detailed costing of the administrative process that added the charges to my account, as banks have already asked to produce by Judge Iain Beresford at Hull County Court earlier this month.
Unfortunately until such time that you make this information available to myself and, should we get that far, to the court, I can not accept any offer less than the total charges applied, plus interest @ 8% as per my schedule, and a full refund of the £120 court fee I have paid. As of today, that now totals £2394.75.
I should also remind you that should you defend this claim and it is passed to my local court there will be a further £100 administrative fee that I will pay and you will become liable for. You will also be liable for a 'Self Litigation Fee' of £230 to cover my out of pocket expenses and time in researching and defending my case.

However, I would like to make it clear that I too am genuinely willing to reach an amicable settlement, and am prepared to accept a sum of £2259.21, plus £120 in court costs, in full and final settlement of my claim.
This offer will be valid for 7 days from the date of this letter. If I do not hear from you within that time, I will continue to pursue the matter through the courts.

Bare with me with this one, its increasingly strange! My claim began in Feb asking Shabbey for statements (account closed 2004) didn't receive them until May and also got my £10 because it took them so long. Claim put in May, standard letter sent back to me, 2nd letter sent after 2 weeks, reply from Richard Harris saying charges just and fair, no refund forthcoming blah, blah, blah! I wrote again giving them the opportunity to repay 85% and if not I would take the matter to Financial Ombudsman. On Thursday receved two letters from Abbey (Richard Harris), both dated 10th July, one said "sorry for the delay sorry its taken longer than eight weeks you can take it to FO if not happy but we will be in touch after review", the second said "we are conducting an investigation". Today (saturday) I received a letter from Mrs Jennie Herbert dated 6th July, apologising for the delay in sending statements advising me these have now been reordered (received them in May??) and will be with me shortly, this is the paragraph that puzzles me and I would appreciate any advice;
"As there has been a delay in you receiving this information, I've arranged to send you a cheque to the value of £40.00. This refunds the £10.00 fee you paid for this service and the remaining £30.00 is to cover any incidental costs you may have incurred. This is in full and final settlement of your complaint and the cheque will be issued within the next seven to ten working days."
Now does this apply to a complaint (which I haven't made) re late statements or to my claim for charges. I think its just about the statements but I would appreciate your opinions and advice.

Phoned Shabbey this morning to see if there was any further update on my claim after refusing my Gesture of Goodwill to be told that it has now gone to 2nd stage, can anybody please tell me what the 2nd stage entails?0 -
I am due in court next week re a £10,000 claim against Abbey. The hearing is scheduled for 10 minutes and is to decide on which "track" is to be used. Can someone please tell me if I need to be fully up to speed with the laws/rules/codes that I am claiming Abbey has broken. Will the judge quiz me? Should I take a lawyer with me? Will Abbey turn up and if they don't will the judge rule for me? Or will the judge just decide on the track come what may and then I wait for a new hearing date. Thanks Wilf0

hi folks, started my claim in jan followed martins directions listened to you all edinburhlass ,brickie 103 to name two. it really helps although i have to say i have court hearing tomorrow 10.30 and received this morning a letter from abbey settleing the claim.cutting a bit fine but sitting here big grin and beer in hand.the moral of the story is stick with it ,abbey are trying to wear us down,but we will prevail.martin for knighthood.0

hi guys please help i have gone through all stages so as to have offered abbey back the £35 settlement they sent now they have replied by telling me they are investigating further ?? should i just now write to ombudsman as i feel they are just stalling please advise0

hi please help me abbey have replied once more to my letter offering back the tiny offer of £35 agaist £1650 of charges telling me they are now investigating my complaint again and may take a while should i now go to ombudsman and sorry if i have posted wrong not very good at this0
