    Personally I'd reject it take it to court and don't accept anything less than 100%

    Oh yeah - on your letter dont use the word illegal, say unlawful, I'm told there is a difference!

    I.F. = £494 charges = £494 received (100%)
    CAPITAL ONE = £981 charges = £1,489.03 (152%)
    BARCLAYCARD = £580 charges = £786.12 (136%)

  • Bear with me with this one, its increasingly strange! My claim began in Feb asking Shabbey for statements (account closed 2004) didn't receive them until May and also got my £10 because it took them so long. Claim put in May, standard letter sent back to me, 2nd letter sent after 2 weeks, reply from Richard Harris saying charges just and fair, no refund forthcoming blah, blah, blah! I wrote again giving them the opportunity to repay 85% and if not I would take the matter to Financial Ombudsman. On Thursday receved two letters from Abbey (Richard Harris), both dated 10th July, one said "sorry for the delay sorry its taken longer than eight weeks you can take it to FO if not happy but we will be in touch after review", the second said "we are conducting an investigation". Today (saturday) I received a letter from Mrs Jennie Herbert dated 6th July, apologising for the delay in sending statements advising me these have now been reordered (received them in May??) and will be with me shortly, this is the paragraph that puzzles me and I would appreciate any advice;

    "As there has been a delay in you receiving this information, I've arranged to send you a cheque to the value of £40.00. This refunds the £10.00 fee you paid for this service and the remaining £30.00 is to cover any incidental costs you may have incurred. This is in full and final settlement of your complaint and the cheque will be issued within the next seven to ten working days."

    Now does this apply to a complaint (which I haven't made) re late statements or to my claim for charges. I think its just about the statements but I would appreciate your opinions and advice.

    In answer to thebluearsedfly, I don't have experience of reclaiming Bank Charges but on first reading it seems that the following sentence could be more concise:

    'For me to be charged a total of £50 for such a breach is something which I regard to be disproportionate, and there are many other examples of this, as previously enclosed to Abbey since raising my complaint'.


    I would maybe have put two sentences, something like:

    'In my view, a total penalty charge of £50 for such a breach is clearly disproportionate. This is just one example from many already fully explained to Abbey in the course of my complaint.'

    Usually 14 days prior to hearing :)

    1 do i send the letter to original address or to their complaint's department ?



    2 i am assumuming it will be dealt with by my local county court
    in martin's temaplate it want's to to state which court ?


    and as a ps type thing do i need to set the ball rolling with the court or do i wait for a reply first

    1. That address should be fine or you could try looking in the help area for a better one

    2. Just put 'my local county court'. If you are using MCOL to start your claim they will allocate you a court once the bank has defended :) So far they have sent my claims to 4 different courts :rotfl: but once you have a court allocated you can move it to a more convenient one of your choice :)

    3. Don't wait for bank to reply - just give them notice and go ahead at your time scale not theirs :)

    Abbey has offered me a goodwill gesture, and i am now waiting for copies of my missing statements to go through it all and then reply to them. The problem i have at the moment is that on saturday i recieved my latest statement saying that next month they will be taking 170.00 in charges from my account, i want to ring them today to have these removed and not taken from me but what do i say to them to get a result ? Any advice please ? :confused:
