I used your letter to ask for my charges back and I have just received a letter from Abbey stating that they do not feel the charges contravene the Unfair Terms.....
I desperately need some advice... should I carry on

Standard reply from Abbey, if you haven't already sent the letter threatening court then you need to send that one now, you'll find the template in Martin's article.

    Hi guys,
i received a letter today from northampton county court to say that they have now served abbey ( claiming £1230 plus interest) so i was wondering what happens now and do i need to do anything? i am worried that i will have to stand up in court coz i havent got a clue what i am doing. Some of you guys are so knowledgeable, but i will fold completely under pressure.
    xx
    can anyone advise?

You'll hear from the court when you case is transferred from Northampton to your local court and they will tell you then if they require further information or an Allocation Questionnaire to be filled in and give you a court date.

Best spend your time having a read of the threads on here while you wait and you will be better prepared. Post up any queries you have once you hear from the court. It might be quite a while to get a court date as this depends on how busy your local court is.
  • Hi all,
I am asking for advice on what happens next -
I have wrote to my Building Society (Abbey) requesting they return my unlawful bank charges - they wroteback to me and explained that the charges were lawful and not unjust! - they then offered me £380 as a jesture of good will!
I declined the offer and reiterated that i want the charges and the interest reimbursing and i threatened court actionif they didnt reply within 14 days!
So my question is - what happens if the bank does not reply to my letter

You carry out your threat and take them to court.

Hi everyone and congratulations to those that have won so far!

I have two accounts with Abeey, one being a personal which has now gone to court, and a business one. I have just started filling in the form for the business account, but the address I have is in Glasgow, and as my claim is for more than £750 it won't accept it being a Scottish address. How do I go about making the claim as it is for £1779.15 in total, or is there an alternative address to use to claim against?

    Thanks Andy

Hi all got my claim back from abbey got as far as mcol they entered defence etc they offered £1850.50 out of a £2848.00 claim, but the claim was wrong due to me messing up on the interest amount claimed should have been £1570 was going to send off amended form to mcol but thought i would hang on to see if abbey queried it.they did not and offered 65% of the £2848 claim so im quids in got more than i bargained:) money already paid in to account funds clear for tomorrow, will then contact my local court to stop proceedings anybody got any idea how to word letter to court please? But would like to thank martin and all his team on this site you all do a fantistic job for the small people against the so called big guys:))

    Hi All,
Has anyone else experienced the following, trying to transfer funds via telephone banking between 2 Abbey accounts & the line cuts you off, so you have to then speak to one of their operators to try & transfer the money? Also, trying to take out more than £200 the ATM (Abbey's) gives a message to say you have exceeded your daily limit?. Are these just more ways of trying to make you give up?

Once again thanks in advance for reply's
