  • I too have started a claim against Abbey back in Feb/March. Got the usual rubbish letters about complaints etc and then on Saturday I received a letter saying that as a "goodwill gesture" they are putting £200 into my account. Flaming cheek, I'm claiming just over £3k!! I have also complained to the financial ombudsman hoping that that would gee them up a bit, but my obvious next step is to issue court proceedings.
  • back in feb i wrote to the abbey about claiming charges back kept getting letters back saying that they were looking into it in may i got offered 175 as goodwill iam claiming 5541.00 so i said no thank you today after a phone call to them i was told that i should be recieveing a letter from them closing the claim and i would not be getting any money. its taken 5 months for this to happen if i go to the ombudsman its going to take another 3 months. very fed up cause other people just get it paid back.

    Hi, Fiirst of all can anyone help? I have had a letter from the court saying the allocation questionaire has been dispensed with. I telephoned my local court and they said they will write to me and tell me if they need the fee of £100 for this. That was nearly three weeks ago. So what do I do now? Do I just wait for a court date. I do not want to mess up now as I started my claim last Nov and am nearly there (I think).

    Secondly I wrote to Abbey and asked them for a breakdown of their costs so I could see where my money was going. They wrote back and said that I am not entitled to this information!

    Keep going everyone if I can do it so can you.

    Firstly dont let Abbey get to you, and definately dont give up. I am also claiming from abbey as you can see below and on Friday I got a much bigger offer basically cause they are scared to go to court.

    I might be able to help you as could many others on here, just need to understand at which step you are at.

    You need to claim soon! Take it to court and don't wait to tell them they will find out soon enough ;) Ideally you should split the claim - say the first 3 years and the 2nd 3 years. this means you have 2 claims under £5,000 which gives you better protection in the small claims court. Add interests at 8% to each charge (use Martins calculator http://www.moneysavingexpert.com/reclaim/bank-charges). The best thing to do is add the first charges first till it gets to near £4,000 with interest and call that the first claim. Then start again with the rest of the charges.

    Splitting the claim also saves court fees ;) well £10 as a claim over £5,000 costs £250 where as 2 claims under £5,000 is only (only! :o ouch!) £240 (2x £120). You will get this money back ;) and you can pay by credit card ;)

    You should have stuck to the time scales listed on this site. Put the claim through the court, let them know you mean business...

    I have sent all of the letters that I need to, to the Abbey, and had the goodwill offer, which was less that 10%!! I didnt mention claiming the interest in my letters, and now I am about to do the court thing. Can I add the interest in my court bit, or is it too late to do that as I have not mentioned it to the abbey?

    The court claim is the perfect moment to add the interest, before you could only ever use it as a bargaining tool anyway. Input every individual charge into Martin's calculator and add it all up. Good luck with your claim!

    Hi

    My wife is with Abbey and has been trying for 6 months to reclaim her charges. they have stalled and sent letters asking for time. She has writtent to them to hasten them and eventually they sent an offer of a goodwill payment of £250 when she is owed £800ish.

    I persuaded her to tell them no, thats not acceptable and now some weeks later they have written withdrawing the £250 offer and saying the matter is effectively closed.

    What should the next step be? My view is to write threatening to take them to court but she is not keen to as she has already made the mistake of listening to me once and considers she may have lost £250 as a result.

    I've read the steps on the site but this seems a bit different as they have withdrawn their offer

    No she has not lost anything yet. She had every right to reject the bank's offer so your advice was correct. Tell her to file a court claim and she will most likely retrieve all the money plus interest and court costs.
