Hi you will know when they have filed a defence as it will say you can no longer proceed online with the claim. The claim will then be transferred from Northampton (where all MCOL claims start) and be transferred to your local County Court and they will send you notification of this in the post,

I received a "Notice that Aknowledgement of Service has been filed" from Northampton county court this morning, which now gives the Abbey 28 days to file a defence, it has been ticked that they intend to defend all of this claim & is signed by Ronan Coyle who is a Paralegal (?). I hope they do want to defend the full claim, because I'd love to have them disclose the full cost of taking charges from us. Just have to wait now for a court date at Huyton County Court, I've got the bit between my teeth for this one, next is my wife's claim, which has just gone to MCOL, and her's is a larger claim again, nearly £4000. What a good Christmas we're going to have (hee hee)

I have finally put in a claim against Abbey via moneyclaim> This time i havent cocked up by taking myself to court!:rolleyes: I got the £120 back from moneyclaim which was good. I am just abit worried now as i havent got a clue what i am doing! so i will be asking lots of advice i'm afraid.

Hi, I wonder if anyone would help me please? I have looked through all of the info about Abbey on this site and I can't find the answer - I'm probably missing what is staring me in the face - sorry if that is the case.I first wrote to Abbey over 13 weeks ago requesting the statements. They sent the last 6 months worth, then a spreadsheet covering the last two years. They then said that they didn't keep statements, but would send me a list of the transactions on my account - which they did. MY transactions, not theirs. I wrote again, emailed and called - only to have the same thing happen again!I eventually got to speak to a lovely bloke (no, I didn't get his name and I am truly kicking myself) who agreed with me, that I was entitled to know how much the bank had been taking from me, and that he would chase it up for me - that was 3 weeks ago- nothing since.I really haven't got a clue how on earth I go on from here. Please could one of you fabulous people help? I've been a complete fool with money and the claim will be for several thousands !!Many thanks and huge apologies if the answer is already here - I genuinely couldn't see it.TillyThanks to this fantastic site and it's amazing people, we have paid over £63, 000 off - just over half way!!!:T THANK YOU:T0

Have you not had your statements yet? Call in the Information Commissioner if its past 40 days. www.ico.gov.uk

Basically the courts are getting fed up with the banks acknowledging and defending claims then once a hearing date has been set settling the claims in full.
So on the grounds of abusing the system the judge orders the defence be struck out that the banks submit against you. They give them a certain amount of time to object to the strike out, in which they have to send in a list of all claims that they have settled before the hearing date, claims they have settled out of court and claims they have defended/not defended in court.
In my case, Lloyds didn't respond to the strike out so because of this judgement is awarded in my favourHope thats a little clearer to you,
