Hi all
have my court date of August 14, won't be here!! im on holiday so have to send proof to court i'll be away. All this started begining of february so hopfully ther's a light at the end of the tunnel!!

Hi there, I recieved my 'goodwill gesture' of £315, I was claiming £1389.00. Im now not sure whether to carry on persuing this, really know where to go from here... so any tips etc would be great!

I had to negociate. I sent an email on 2nd July 2007 to Ronan.Coyle@ashurst.com with the follwing text;
"WITHOUT PREJUDICE"<o:p></o:p>

Dear Sir or Madam,<o:p></o:p>
<o:p> </o:p>
RE: SELF -v- ABBEY NATIONAL PLC<o:p></o:p>
CLAIM NUMBER: 7QZ66464<o:p></o:p>
It has come to my attention that as of 14<sup>th</sup> June 2007 that an Allocation Questionnaire may not be required in this case.<o:p></o:p>
I am mindful of the vast number of claims with which you are currently dealing. In order to more speedily resolve this matter, I am willing to accept the sum of £3300. I do not agree to waive my rights in respect of any other actions, nor do I agree to a clause of confidentiality.<o:p></o:p>
I hope to hear from you very soon so that a reasonable conclusion to this claim might be achieved. I am sure that the courts would approve of our settling this matter in a timely manner and without their further intervention.<o:p></o:p>
For your records, I enclose another copy of my schedule of charges. I look forward to hearing from you."
On 10/07/2007 i received the follwoing reply;"Without Prejudice"Dear SirThank you for your offer to settle your claim below in the sum of £3300. I can confirm that Abbey cannot accept that offer as we feel it does not appropriately take into consideration our contentions that if you were to win at court an element of each charge imposed on your account would be deemed as legitimate.However, in the interests of continuing negotiations we are minded to make to you a counter offer in the sum of £2744.47 which will be in full and final settlement of your claim and on the basis that Abbey accept no liability.Please confirm by return whether you accept of decline this offer.
I immediatly replied with;

I can confirm that I cannot accept your offer of £2744.47 as it does not reflect the added legal costs, my very expensive time and indeed distress suffered by me as a result of having to bring this court case when your client could have just refunded the money that it illegally took from my account in penalty charges.<o:p></o:p>
<o:p> </o:p>
However, in the interests of resolving this matter as speedily as possible, I am willing to accept £3000 (three thousand pounds) as a full and final settlement of this matter.<o:p></o:p>

And they then accepted that offer about 10 minutes later.0 -
I used your letter to ask for my charges back and I have just received a letter from Abbey stating that they do not feel the charges contravene the Unfair Terms.....

Hi, new to this! I've read thru page after page and can't find anyones situation thats the same as mine...
I wrote to abbey, asking for £2070 in charges to be refunded, they wrote back approx 3 wks later saying they would investigate etc, then again a couple of weeks after that apologising for delay, then just as i was about to send off second letter, i recieved a letter with an offer, for £445 as a gogw. This amount would be paid into my bank within the next 10 days or so....i checked my bank that night, and they have already credited me without my acceptance??? I've only 2 weeks to reply to them, and i'm unsure of what to do? PLEASE HELP!!0 -

If you wish to reclaim more, send them a letter stating this is only accepted as a partial payment and you will pursue them for the rest.
You then continue with the process and amend the amounts to reflect the money already paid to you. Be careful as some bank take back their GOGW if you continue the claim. This of course doesn't look good for them if it goes to the ombudsman or court.0 -
After batteling with the Abbey for a short while they have made me an offer?
I worked out including interest, they owe me £2477.36.
They have made me an offer of £1610.28
On the condition:
Abbey-' This offer is conditional on the Abbey National verifying the charges sought in your claim. In addition any amount of monies allready refunded to you relating to the charges claim will be offset against this settlement offer.'
What does this mean?0 -
I think what they are saying is that the figure mentioned is payable provided you havent yet received a payment from them.
bets to pick up the phone and talk to them.
if i were in your shoes id take the money and run as its a nice amount of cash and its likely you'll get it quite quickly.
