    Hi Nick,
    I wouldn't be worried about going to court, from reading all the other posts here I'd say as long as your court bundle is up to scratch, then you don't have a thing to worry about, as the bank will probably not turn up anyway. Also you've got all the great people on this site to turn to if you get stuck or need any help with your preperation.

  • I woke up this morning to find a letter from Abbey on my doormat with a copy of the Defence they have filed with the Court which basically says they disagree with my claim.

    Funnily enough they have made me a standard offer of 65% £1546.50 as a GOGW.

    I will be contacting them by phone today if they are open on a Saturday to decline the offer, as well as replying by mail.

    I am pleased to be seeing the light at the end of the tunnel, and was quite surprised that they made the GOGW before a Court Date was set.

  • Right, have followed the advice contained on this web site and the forums and have seemed to have got no further

    case 1 - claiming £700 for bank charges form an abbey account and have recieved 2 letters in return for my original claim. the first was from the banking specialist team telling me it would take 4 weeks to look into it, after 4 weeks got a letter from the complaints dept saying they needed a further 4 weeks to look into it. question is where do i go from here. do i wait the extra 4 weeks or do i go to stage 2 and threaten to take to court etc. is it worth ringing them at all, i know they will just fob me off if i do.

    case 2 - on an old abbey account i am claiming over £5000 in bank charges, sent the first letter and recieved no reply, sent the second letter to the complaints dept threatening legal action with an offer to settle for £4000 and recieved no reply. the 14 days i gave them to reply is up. why do they seem to reply to the lesser amount but not to my other letters. do i now just proceed to court/omnisman to try to get the money back?

    what is the address thats the best one to use to get a response from the abbey, i have tried both handing into the branch and writing direct to the complaints dept and have had no luck with either.

    i seem to be getting nowhere so any advice is appreciated

  • start the legal process on both of the accounts.
    they will acknowledge them once you get the courts involved.
    don't panic either..............the whole process takes a while.
  • oh...............claim for everything and wait for them to make an offer. if you tell them straight out what you'll accept, it might be less than what they would have offered.
    personally, i didn't except anything less than a full and unconditional payment.

    How far into your claim are you, I'm having real trouble with Abbey, when I try & move money between accounts using telephone banking, the system just closes down & when I request a balance at the ATM the message comes up saying that the service is not available, but my wife can get a balance, also trying to withdraw money the ATM message keeps saying I've exceeded my daily limit! luckily I've opened another account with A & L so will be closing my 2 accounts when all this is done :mad:

    I am 19 days into the MCOL, Abbey had until 23rd to enter a defence, which the letter I recieved this morning states they have.

    I was not expecting a GOGW this early in the proceedings, as most people sem to get them only when a court date has been set.

    I tried calling this morning but the numver on the letter was just ringing and ringing, I guess they aren't that busy that they have to employ staff at weekends to cope with all the claims.

    I will call again on Monday and inform them that I will not accept the GOGW, although they may well pay it into my account by then.

    Fortunately I am not desperate fot the money, so I am contemplating taking it all the way to see how things pan out.

    With regards to your offer of £1309.75 in full and final settlement of my claim, I would like to inform you that I am not willing to accept this offer.

    You infer that I am of the belief that I should not have to pay any charges at all. This is completely untrue. What I am objecting to is the way your charges are totally disproportionate to the cost of the breach on my part, and therefore illegal. If you could reveal to me, in writing, exactly how much it costs for a breach of, for example £2.08 (as occurred on my account on 7<SUP>th</SUP> November 2006), for 1 day and an automated letter to be sent, I would happily pay this amount. For me to be charged a total of £50 for such a breach is something which I regard to be disproportionate, and there are many other examples of this, as previously enclosed to Abbey since raising my complaint.<o:p></o:p>

    As I have stated above, I do not wish to accept your offer of £1,309.75. My total claim is for £2,015. However, I would like to make it clear that I too am genuinely willing to reach an amicable settlement, and am prepared to accept a sum of £1,860, plus £120 in court costs, in full and final settlement of my claim.

    This offer will be valid for 7 days from the date of this letter. If I do not hear from you within that time, I will continue to pursue the matter through the courts.
