    This is my 1st posting after reading everyone else and was wondering if anyone else was going through the same.:mad:
    I 1st request my 6years statements in March and received them like many other people in dribs and drabs and I also had my inital £10 refunded due to the length of time this had taken.

    23/04/07 was my first inital letter sent recorded delivery ( a lesson learnt long ago) giving them 14 days to respond.

    12/05/07 second letter sent with the calculator spreadsheet showing my calculations and dates again sent recordered delivery. I also added at the bottom of this letter they had until the 5th June to reply as that was the date I was returning from my holiday.

    05/06/07 returned home from my holiday to a bog standard letter apologising for the delay.

    I thought about taking it through the small claims court but I decided to go through the FOS as I read that if you loose through the courts you could not do this.

    21/06/07 complaint logged with the FOS and confirmation letter received on the 27/06/07

    In the meantime I called the complaints dept of Abbey to see if they would consider making me an offer to which I was told a letter was sent on the 14/06/07 making an offer of £983.00 to which I laughed and refused and told them I had now logged the complaint with the FOS.

    03/07/07 I received a letter dated 26/07/07 saying that they had carried out a full investigation on my behalf and as a "Goodwll Gesture" would be happy to refund £983.00 and my account updated within 10 working days.

    As anybody else had this? After refusing this over the phone would this still be deposited into my account?

    Update 10/07/07
    The "Goodwill Gesture" was paid in on the 05/07/07 I have spent 45 mins today to several depts including the Chief Executive Office, to reiterate that I did not accept this refund. They have taken it off my overdraft and refuse to take it back. The Chief Executive were either use nor ornament. I work in a large call centre and I know that our own CEO bends over backwards to help customers!!! You would be surprised also as to how many staff did not know what a CEO was or indeed their number!!!

  • I would let the financial ombudsan sort it out for you.As you say you have reported it to them they will also get the same leters as you have been sent from the bank. I would also send them the letter of refusal to your offer of goodwill

    We had this with my OHs TSB account, because his account was closed and still registered at his old address they wouldnt send them to our house. After phoning them several times and argueing the fact you have a right to this info they agreed to send them to a branch and he had to take id in to prove who he was.

    Dont let them fob you off.
  • My son started to reclaim back the bank charges back in Feb has received only 1 letter from the bank They are still charging him every week with bank charges.
    It all started when he was overdrawn fair enough he made that mistake but when he got paid the bank took all the money that he owed in bank charges in one go and that left him overdrawn again he has really tried to get out of oweing them money but every week is the same, as he gets paid the bank takes it and he is left overdrawn again. could anyone give me some advice on this please thanks

    Abbey are the worse i think for trying to claim back. I wouldnt worry too much about time delays i started mine in november and court date for 20th sept so its taken me 10months hopefully to get a result. Stick to martins time scales on the templates if they dont respond send another letter in.

    Firstly he needs to open another account to stop this practice dead in its tracks. He neednt pay another penny in charges and should get things moving again with the reclaiming process immediately.

    I followed the steps as suggested in the article and got to the stage where I sent them a letter threatening to take them to court to reclaim my fees of @£1400. However, whilst I was away on holiday, I had received a letter from Abbey offering to pay £130 back into my account as token payment and that the payment would be paid into my account within 5 working days.

    Am I still able to claim the full amount and proceed to court? Or is this the end of the line for my claim? There was no indication in their letter that acceptance of this payment would not allow me to claim further.

    Grateful for advice.

    Obviously, it all depends on your circumstances and the amount involved (both in real and percentage terms) but, personally, I regard any part offer or payment as an attempt to take some of the charges from you for a second time.

    <O:p</O:pIf it is a full and final settlement, write back to the bank, politely refusing it. Continue your claim.

    If it is a gesture of goodwill, write back to the bank, politely accepting it as a "part payment without prejudice". Continue your claim for the rest.
    The acquisition of wealth is no longer the driving force in my life. :)

    Ive just had the same thing happen to me. Abbey owe me 110.00, they have offered 20.00. Ive sent the template letter back "without predjudice".
