    hello i am unsure what i should do next. i contacted my bank (abbey) asking for my charges to be refunded, i sent the first 2 letters asking for 2500 and i eventually got a reply saying that the bank thought my charges were fair and correct however they paid £420 into my account they said as a gesture of good will.now i am unsure how to proceed as the next step is starting court proceedings and i would be gratefull for any advice about what to do next

    Hi all

    i started my claim by following the advice and help i received from this site, posting my charges request to Abbey on 17.01.07, i received an acknowledgement for my cheque on 29.01.07. i received my statements on two dates 01.02.07 and 09.02.07.

    i wrote making my claim on 22.03.07 receiving a letter of receipt on 03.04.07 followed by a delaying letter on 28.04.07.

    on 19.05.07 i received a letter notifying me that they had put £80 in my account as a goodwill gesture (somewhat short of the £1660.00 which i am claiming for) but were not going to make an offer and that i had eight weeks to respond or they will assume i am happy and close my file.

    i am disabled and have not been able to deal with this sooner and have worked out that the 8 weeks are up next tuesday.

    i am just after confirmation of what my options now are and if there 8 week deadline is binding as i have no intention of giving up as all of the charges relate to when i became disabled 6 years ago. also do i need to make any comment to them about the £80.00 which they credited my account with which i intend to use to fund my court claim with

    Write them a letter saying you reject their offer but will accept the money as part payment of all that they owe you.

    Things have moved on for me. Got my court date of August 15th. Should have my documents sent off to the other parties this weekend if not next at the latest.

    Is it unusual that Northampton County Court not only automatically transferred my hearing to my local county court (Hertford), but also stated that I was not required to fill in and return an Allocation Questionnaire?

    Btw, Standard looking 10 Point Defence by abbey - Check.

    Well i got my court date the 20th sept for Abbey, I havent had a letter or anything off them so just waiting now. I orginally said i would accept £3k but now charges are £4131 plus interest and court fees totally nearly 6k. This has been going on for me since november how long did you all take to get a result.

    Hi All,
    Moneyclaim on line served against Abbey yesterday, hope they're so snowed under they miss the deadline for defence. Should I start putting my court bundle together now (I've got some of the paperwork downloaded already), or should I wait for the court to contact me with a date :confused:

    There's no point in dong it yet as you may not have to ie if they settle in full before. Wait until the court gives you a date.

I received a letter saying they were dealing with my claim and it could take up to 8 wks. I received a letter last week, informing me of a refund of £310. They have said that this amount is a goodwill gesture and that the office of fair trading announcement was in relation to teh credit card default charges and not charges related to accounts such as bank accounts.

    Has anyone actually had any joy with Abbey? I've seen many threads on Barclays, HSBC etc. I'm not sure what to do from here.

    As the part refund is a gesture of goodwill, write back to the bank, politely accepting it as a "part payment without prejudice". Continue your claim for the rest.

    As you have not received an acceptable reply by your deadline, send them the second “Letter Before Action” letter.

    <O:p</O:pAt this point, you have to decide between referring your claim to the Financial Ombudsman and starting court proceedings.

    If you don't think that you could successfully handle a court claim, or can't afford the court fees and aren't eligible for fee relief, then the Financial Ombudsman is an alternative. It is free of charge and handles everything for you. They charge the bank involved £400 for each complaint they accept. However, they cannot award interest like a court. Their success rate is good but, if the Financial Ombudsman is unsuccessful or the settlement is unacceptable, you can still start court proceedings.<O:p</O:p


    If you threaten to refer your claim to the Financial Ombudsman, give them until 8 weeks from the date of your first letter to reply. However, if the reply either suggests that you now refer your claim to the Financial Ombudsman or says a definite no, then you can refer your claim to the Financial Ombudsman straight away. If you have not received any reply for the 8 weeks, you can then refer your claim to the Financial Ombudsman.

    If you threaten to start court proceedings, give them 14 days to reply. If you have not received an acceptable reply by your deadline, then start court proceedings on Money Claim Online.
