    Hi EFC40, they are not silly questions. Yes you can still claim the charges for the last 6 years but dont forget to take off what they have already refunded. The Abbey didnt stop my overdraft when I claimed, so you may be ok, open a 'parachute' account just in case. Good luck, be persistant and get your money back! Good luck, Sarah

    think i will start the ball rolling and see what happens

    do i send first letter to the head office..?

    the other thing i am concerned about is if they cancel my overdraft and because i wont be able to pay it in full they get debt collectors involved, this will make my credit reference suffer for the future..?

    4 June - we received a letter from the Abbey offering a refund of 65% of our claim.

    7 June 07 - we made an offer to Abbey for 3,700 to settle out of court.

    14 June 07 - I finally got through to the Abbey and the lady I spoke to said that they were only dealing with cases that had 3 weeks to go until their court case. As we hadn't even received a court date, we were really tempted to cave in as we needed the money.

    20 June 07 - we received a letter from the court to say that our case had been transferred to a local court.

    22 June 07 - they deposited a cheque for 3,700 directly into our Abbey account, which will cleared on Weds. We haven't even received a letter from them. Very bizarre.

    29 June - now that the monies have cleared, we have sent a letter to the court, cc the Abbey, saying that we wish to withdraw our claim

We were determined to get our money back as their charges just made us spiral out of control and caused us a considerable amount of stress (back in 2003). I know that we accepted slightly less than we asked for but it wasn't that much less ie 15.68 less than the original amount + 120 court costs.

    do you have a contact number at abbey of the lady you spoke to as immediately before my court date i will be out of the country for 3 weeks and i'd like to make them aware of that fact to see if they'll pay up before i go on holiday.many thanks
  • I may put this up on the main board as well but I need a little advice/enouragement about a partial offer made for my claim with Cahoot (via Abbey).

    I have been offered 65% of my claim amount and having managed to finally speak to someone helpful today I was told that if I wish to continue and contend for the full amount I was unlikely to be successful.

    Instead I was encouraged to make a 'reasonable' counter-offer and that it would be considered in due course.

    Now, aside from the obvious motivation to deter me from lengthening the process (thus costing them more) is there any precendent for Abbey not paying out in full before the court date rolls around?

    Given that to them the difference in offer is minimal (around £800) but very significant to me I want to continue.

    Can anyone with experience of this offer any advice?

    Hi All,
    Quick question(s), can I add charges to be taken out of my account, to my claim, and do I add interest from date of first claim to my MCoL which I'm filing today against Abbey, at the rate they are going it's pushing nearly £3000.

  • I haven't got the letter with me, with their telephone no. However, there's probably not much point in talking to them. It is all a waiting game. They play mind games with people in the hope that they will cave in. The less they can get away with paying you and the longer they keep you waiting, the better it is for them.

    don't panic!! like feater says you can amend your claim once you receive notification that it has been transfered to your local court............once that happens give them a ring quoting your claim number and they should advise you of what to do (n244 form)...............all is not lost......it will cost you an additional £35 though

    besides can't shoot u.....................no bullets left:rotfl:

    EFC 40, I think if they cancel the overdraft and get debt collecters in you should make an immediate case for the ombudsman, because it will look as if its been done because of your claim. They may threaten to withdraw the facility if you decide to claim, but its down to you to make the claim to make them pay up. I had an 800 quid overdraft when they closed my account and I have yet to recieve a request for this money. When I wrote to the ombudsman I mentioned this, I am now waiting to get a reply from the ombudsman, he'd only had it since March, I dont know how long to give them. If they close the account and withdraw the overdraft then you will be compensated by the ombudsman and have your account re-opened if the bank cant prove it wasnt related to bank charges. Hope this helps. Send the first letter to the address on your bank statements, their HQ. Good Luck, Sarah

    We are at the stage of preparing our court bundle and I have also realised a mistake in the charges that we originally put into our spreadsheet. They included interest taken when we were over our overdraft. Can I amend the new spreadsheet being prepared for the bundle, or do I have to stick to the original amount? Obviously this will have changed anyway due to the interest and the length of time that Shabbey have taken in dragging their feet.
    Any advice greatly appreciated.
