    Hi every one

    I need some help the abbey have give a goodwill gesture £140 and say that there charges were correct and i am claiming back 2300 and do i do now please help me thanks kat

    Hi Kat1234, if you read up this thread you will see that this can be a starting point for negotiating with them to get the full amount. But please dont settle for less than 100% they have a lot more to lose by going to court (which they never have yet) than paying what they owe. Good Luck and all that, Sarah

    Hi fumingforcash, (what a great name by the way), I would start to prepare your court bundle and wait for Abbey to contact you. The CAG is a good site, and as far as I am aware, your court bundle is personalised to you and your claim. I would put the audio transcript from the Lloyds bank exec in as well. I am sure that Abbey will be in touch to offer a paltry settlement before the court day arrives, some have been known to arrive the day before, an offer to settle in full, in which case people are advised to attend court and say that the Abbey have offered to settle in full and the judge just rubber stamps this. Remember if you settle for less than what you were charged, its cost you to get this money back, ie mcol fees etc, so hold out for 100% which can be hard especially when you are as skint as I am, lol.     Thank you so much for this. Am I right in assuming then that even if a full offer is received by Abbey the day before the court date; you would suggest that we attend court and the judge rubber stamps the offer. Obviously if we have the money in the account a couple of days before the cort date we then can contact the court to stop the hearing. I am currently waiting for the T &C 's to be sent out by Abbey to include them in the court bundle.

  • I amcurrently trying to claim about £3000 off abbey. I had received 1 settlement offer off them for £1800, which i turned down.

    I am now at the questionnaire stage of the court action. Can anyone how has had dealing with them tell me does Abbey like to hang on till the last moment to settle?

    Yep, if they make a last minute offer, get the judge to rubber stamp it, ie Abbey have offered to settle on full the amount claimed plus court fees. They have 7 days to pay up or the court will enter judgement... the CAG will give you the exact wording. I know the hardest part of all this is the waiting and they just do it to wear you down. Are you near Essex? if you are, I will be your court 'buddy' if you want, although you may prefer to take someone who has actually been in the court room, cos they settled with me at the allocation stage! Have you tried the Abbey website for the T&Cs???? Let us know how you get on, kind regards, Sarah

    No I live in N Wales but thank you for the offer. I am not too concerned yet about the court as I have other things to stress about lol. The claim is my son's and he will have to act on his own but I will go with him. Hopefully this won't happen of course. I did try the website for the t & c's but the one CAG recommend(can't remember what it was called) and Abbey had blocked it. I will however try the Abbey website. I did send the request by recorded delivery and I've tracked it as being delivered. Will keep in touch. You may be sorry you offered!
