  • I'm have just printed of my letter and have it ready to send tomorrow. I've been banking with Abbey a good while now (they are swines) and was just wondering if anyone had any success with claiming back charges through them?

    I'm totalling near £900 in charges over the years but somehow doubt I'll get it back, never been the best bank to deal with though I have opened an account with alliance and leicester and they have been great.

    Hello ive claimed though abbey but got nowhere they will not back down to us mere mortals i.e the customer but they will through the financial ombudsman i started with writing letters to abby in total 12 weeks of waiting and phonecalls and letters but they kept fobbing me off. 4 weeks ago 4! i went through the financial ombudsman and last friday i recieved a letter saying that abbey will settle my claim for £3050 my full claim is £4460 im in 2 minds wether to accept but probably will. Go to the F/O straight away Abbey need to pay the F/O to investigate obviously abbey dont want to be investigated because they now theyve got to pay out.     I have a court date set for the 11th Sept. I've decided to write to the bank to give them one last change to settle out of court. Any feedback would be appreciated before I send the letter:

    Abbey PLC

    Dear Sir or Madam,

    Re. Account number: xxxxxx
    Your REF: xxxxxxxxxxxx
    I refer to default charges applied to my account amounting £4671.41 which I have requested you pay back.

    I wrote to you on the 11th January and the 5th March, making the original request for a payment in settlement of my claim. You have decided to defend this in court and we now have a court date of 11th September 2007.

    Based on the Unfair Terms in Consumer Contracts Regulations, I believe these default charges are unfair and not proportionate to your costs, and therefore the Peterborough County Court will rule in my favour. I am aware of the recent high profile case of Berwick v Lloyds TSB in Birmingham, which went in the bank’s favour. However this case has not set any precedent, is an exception and all cases since then have been found in favour of the claimant. I will attend court fully prepared with a counter defence using the many resources available on the internet.

    I have attached a full updated schedule of the charges and interest with this document. The new total figure including recent charges and the court fee I have paid is £4926.41. If this case goes to court I will also have to add loss of earnings of £200.

    Without prejudice
    The charges and interest I have claimed above total £ 4926.41. However, if you are prepared to pay to me £ 4500 within 14 days of the date of this letter (and, for such purpose, time shall be of the essence), I am prepared to accept this lower figure in full and final settlement of my claim and interest.

    Please feel free to call me on the above number if you with to discuss this with me further. I look forward for a full response to this letter within 14 days.

    hi all got mcol going against abbey they entered defence havnt heard anything from them yet they have till 5 july the end of the 28 days to respond if not ill go for judgement not even had a offer of them yet let you know what happens nearer the time.
  • I have just wrote letter to Abbey about 3 weeks ago requesting £890.00 back from them. I received a standard letter stating someone is investigating, how long does it usually take for them to reply? Also since then i have received another £245 worth of charges, how do i arrange to get this back too? Will i have to write to Abbey again to request this?:confused:

    Shona, stick to your time scale, the banks wouldn't give you 6 weeks to find the money for charges to be taken from your account, so don't give them the 6 weeks to fob you off. Start your MCOL now, that seems to be the only way that they will finally make you an offer, at the end of the day it is YOUR money. Go for it kid!

    Yeah Shona start the proceedings that'll get them moving! They're taking the mick out of you.

    Hi, you can keep adding additional charges onto the original amount up until you file your claim at court :D

    I suggest you send them the letter of refusal before action is taken

    I've started the process of reclaiming my charges from Abbey. Sent off for statements, sent of first letter with schedule of charges &interest. Have now received a letter from Abbey saying they're "investigating" and it will take 4 weeks. Do I wait for 4 weeks, or do I stick to the 14 days as stated in the letter template?

    sorry to be a pain but could you give me a few tips on what to put in the letter i'm getting a bit confused with it all
