I have just posted my success story on the success thread.
I started my claim against the Abbey for £4800 in early March, followed Martins advice to the letter, received £995 in April as gesture of goodwill, carried on with court claim, had court date of 12 July, then today I receive a letter agreeing to pay a further £4160 in full settlement.

Dont be disheartened, just stick to the advice given on this site and hold your nerve.

Hi, i have just had a letter from abbey sent only 7 days after I had written to them requesting my £1600 charges back inc. interest with a letter stating that the 'charges debited from your account are correct and Abbey hasn't made and error to cause the account to go OD. Also stating to avoid charges etc and the details on moniotr and the veiled threat that if the complaint escaltes into the County Court they will review each case and if feel that the relationship with the customer has broken down may decide to give notice to close account.' So i rang today only to be told this is a stalemate letter and that if I want to take it to stage 2 then gave me a new number to call. As yet not rung the number, what is stage two and has anyone had this from Abbey and what did they do?

I made my on-line court claim last week and have had an acknowledgement of service today.
I had a horrid thought tho....IF i get my money back would they decide to withdraw my overdraft facility ,so any money they give me back will just get swallowed up by this. Its exactly the same amount im claiming so i wouldnt see any actual money ): Has this happened to anyone else ?0 -

I am Sparklebarcll not Martin, I was just thanking Martin Lewis whose site this is.
The Abbey havent closed my account but I did open another account just in case. This site does advise you to, but at the end of the day its your decision.

That's my court date too. I just got the letter today saying they're defending the charge. :eek:0 -

I have recived a defence from the Abbey and an offer of 65% of my charges from the Abbey£1,800, I have responded asking for all of my charge money paid less £5 per charge from them, I have given them 10 days to respond and will then defend in court if nessesary, has anyone got this far with an Abbey case going to court, can you assure me that they have not turned up at court to defend a case?
They are saying the following for their defence,
1/ You can apply for an overdraft if we give you an overdraft we will tell you your limit and interest applicable.
2/ An unauthorised overdraft occurs if without agreement you overdraw your account or exceed the limit of an overdraft which we have agreed.
3/If you have an unathorised overdraft you will be charged fees as set out in our tariff of charges specified to you and these may include fees for transactions we are unable to process due to lack of available funds in your account. It goes on to 10 other points in the same vein, is this just scare tactics? ANY ADVISE PLEASE, SHOULD i TAKE THE OFFER OF 65%??0 -

i just need some assitance.I done this some time ago but not been very well and everything got to much for me.I feel i am strong enough again to fight but i need your advice.
I got to the final stage just before court they offered me £850.00 i did not except as a final payment they just paid it straight into the abbey bank (which they closed)but still paying off o/d .
it as now been at least 6months and i have done nothing else.
what i am basically asking is how do i approach do i just resend the letter saying that i am taking them to court if they do not pay me the unfair charges back the total is £6000,00 of unfair charges.
and should i send a cover note explaining why i have left it so long?????
on the ground s that i have been feeling depressed and i have lost my job.
am i still entitled to claim ??
I am unemployed also at the moment so the £250.00 would be hard to raise ,is there any help i can get.
i would appreciate your expert advice.
