    Hi

    I put in my claim to Abbey back in April - was sent the standand 8 weeks letter. Spoke to them after the 8 weeks (by phone) to be told that they were making a good will gesture of around £200 my claim is for approx £4200 in interest charges . I refused this amount and asked them to reinvestigate

    Abbey closed down my account when i obviously couldnt pay back all the charges in one go - so they closed my account - and took back the cards etc. I paid them of weekly - this ended arounded Feb 07. My account was in credit by about £300 - but abbey were not quick to send this to me . Anyway i checked my balance and it seems that they have put the gesture payment in my account - i did not even receive a letter

    Abbey have tried to block me in everyway possible

    I spoke to them yesterday - where they claim that again it is being investigated - because i refused the gesture. I am fed up . i did fill out money on line - but did not process - cause i thought they would come up with a better offer- and because it was during the time when the judge ruled in favour of the bank - so i was nervous to go further

    Thanks for your reply - i am just very nervous cause abbey seem to b very awkward. Abbey seems to be defending their cases . which is partly why i was holding out

    I did get back 1500 from hsbc - after about 10 weeks but they were very good to deal with - plus u can actually speak to the person that is investigating it

  • Have just been given a court date of august 14th, but won't be in the country as i'll be on holiday. Do i just ask for another date, or will they go ahead without me??

    I've been claiming £1278.50 from Shabbey (over £2000 with interest and charges) since November and I have a court date of 27th June.

    Yesterday I received a 'without prejudice' offer (via e-mail!) from them of £1700.00 which expires today at 17:00.

    I've decided to reject this and ask for the full amount. I'll let you know what happens...

    iv just asked them for all the charges from my business account and i know thats had more charges

  • The limit is £5000 at the small claims court but you can split the claim into 2 as to not go over the required limit on each claim. Say to claim 3 yrs on 1 and 3 years on another,

    The only limit is how much you've paid in the past 6 years!

    MCOL has no limit on claims but there are slighly different rules as you no longer become a small claim when you go over £5000 but its OK you can still start to follow the small claims root that the rest of us are. :)

    There was a recent bank charges claim that started on MCOL (reported on BBC NEWS website) for £24,000+ and £12,000 interest!

    However, the best thing to do is split it into 2 (or more) claims, 1 for each account. This should at least get one of your claims under £5,000 if not both! You could also split it into years. I have 2 claims in with Barclays, one for 2002-2004 and the other for 2004-2007 ;)

    Remember that your claim is your charge value plus interest. :)

    I want to say that I could never get through or even start any of this without the good people on this site. Nobody cave in even if you are unsure what to do, Abbey National are just an awful organisation.
