    Abbey have defended my claim. They are offering me 65% of the £3500 they nicked off me. They say they have a right to charge me but they nearly made me homeless taking £315 out in charges on my rent day. I am not accepting this, but should I write back and tell them or just let the court action take its' course?

    I have filled in a N1 claim form and taking it to me Local county court tomorrow before I go to work. I know I`m owed that money back and I intend to get it.

    fatcarper, Horscrs1Proceed with your court claims, they are just stalling as long as possible. they will not settle or start to negotiate until just before your are due in court.Yeovillad, ask the abbye to break down their charge, you are not disputing there right to a fee to cover their costs but the fact their present fee is disproportionate to what it costs them and is therefore an illegal penalty.This got me a 100% settlement from themGood luckSarah

    download a complaint form fill it in send them proof of your charges along with the form and they will do the rest for you f o c dont waste money by going to court and making your self ill with worry at the end of the day the banks will try every trick in the book to scare you off as they are at fault not us poor people

    Hi Sharon

    Thank you for your post but I believe those of us already in the court process can't go to the FOC now. Court date for 23rd July but hopeful that they will settle my son's claim for £2500 in the 14 days prior. No response apart from Abbey defence and we haven't made any contact with them. Not stressed as yet but will be as time gets nearer but determined to get his money back.

    Hi I am claiming my bank charges from the Shabbey (love that name BTW), they initialy offered me 10%, i responded by issueing a claim vie the small claims, and they have now offered 65% and put in a defense as well

    My questions are;

    A) do i accept?
    B) Counter offer?
    C) fight all the way?

    I'm sure this route is going to be very handy for some people.

    However, it think it should be said that it does take longer this way. There is no reason why this process has to be complicated.

    I just won my money back without going to court, (was just about getting my court bundle ready!) i received nearly 3k from Abbey.

    Like its been said before, abbey will not settle until you have a court date, they will push everyone until the last minute.

    All i did was extensive reading on this website and on the forum, reading the posts on here answered nearly all of my questions.
    Everyone thinking about doing this should read the article on the website thoroughly and save all the letter templates.

    Advice is also available on the consumer action group website, for more complicated claims.

    My point is, as long as you're prepared to do the reading up, claiming yourself is dead easy.

    Believe me, i aint a college graduate, law student, or legal boffin and i did it.

    the rest of you can too.

    So dont let the banks jargon and big words put you off.

    think about it this way, if you owed them money, they wouldnt think twice about bombarding you with letters and phonecalls, and they certainly wouldnt wait until you got the money together to pay a bill, so why should you wait 4 weeks for them to investigate your claim??

    Stick to your timescales!!

    I'll get off my soapbox now, just felt like i should give you all a boost!!
