Yes just send the letter before action, deducting any sum they have paid to you as a part payment.
You may be exempt from paying court fees if you are unemployed ? Here is a link to exemption

I've been claiming £1278.50 from Shabbey (over £2000 with interest and charges) since November and I have a court date of 27th June.
Yesterday I received a 'without prejudice' offer (via e-mail!) from them of £1700.00 which expires today at 17:00.
I've decided to reject this and ask for the full amount. I'll let you know what happens...
Received a letter this morning from Shabbey offering the full amount requested (£2065.51) which is my charges, full interest and court fees! Now as long as the cheque actually arrives I'm one very happy bunny.

Hello all.
I'm currently claiming back charges from Abbey on behalf of my Fiancée.
The charges amount to £4129.94, from 2 accounts.
After receiving the initial reply from them of "we are looking into it" we have had no replies from our other demands.
We are now at the point of taking court action.
A few questions hopefully the more knowledgeable people here than myself can answer.
Is it better to use money claim? If we do, is it better for 2 separate claims or just the one? (as the total amount is for 2 accounts)
Or shall we use the Financial Ombudsman?

Beginning to lose patience with Abbey now and I've just started! First time I sent for my statements they sent a letter back saying they couldn't find my account - turns out they were trying to use the number on my cheque - so I resent after comfirming the account number was infact correct. But today I received another letter saying they couldn't find it again,so I phoned only to be told that my account number had been changed which is probably why it couldn't be found!
Now why didn't they tell me my number had changed either by letter or the last time I phoned last week? And if one person could find it and tell me it had changed why couldn't the department who I'd asked for the statements from find it?
I'm seriously thinking it's complete time delaying/put off tactics. :mad:0 -
I also had the offer of 65% in settlement and was quite tempted but I read somewhere that the next stage is not too difficult so decided to hang on in there. I am now preparing my Court Bundle and wondered if anyone else has done this. I have most of it together but do not know where I can find a copy of the Abbey T & Cs from 2001. Any help would be appreciated.There are three ways to get something done; do it yourself, hire someone or forbid your kids to do it.0

I have a date for court Jul 23rd and have written direct to the solicitors acting for Abbey requesting the T & C'S for the time period invoved in my case. Sent it recorded delivery. If they don't send it at least it shows I requested them.0 -
Hi Im IXS, Skin girlWe have used money claim online for its convenince, and have always kept each claim separate, so that we knew where we were with each claim. Skingirl if you read Martins guidelines and follow the wording it will tell you how to go about taking the abbey to court. Expext delays and delaying tactics, its what they do best.Good luckSarahSarah0

I am about to make my claim to Abbey for 6 years bank charges and want to get it right ! On the statements sent to me there are lots of entries saying 'Cleared Transaction CHG ' and all of these have a -£10 charge against them.
Could anyone tell me what this charge is, and if it is a charge, can I claim for these ones:o . Many thanks,0 -
I'm have just printed of my letter and have it ready to send tomorrow. I've been banking with Abbey a good while now (they are swines) and was just wondering if anyone had any success with claiming back charges through them?
I'm totalling near £900 in charges over the years but somehow doubt I'll get it back, never been the best bank to deal with though I have opened an account with alliance and leicester and they have been great.Money's our first priority, it doesn't make sense to me -Simple Plan - CrazyDebt at lightbulb moment 13/12/07 £13820.
