You should be able to amend this with a N244 form, and you will need to pay a £35 fee (non refundable). Might be worth ringing the court to confirm this is covered by the form.

thanks feater. i rang them this morning. they can't credit my card back, but they have cancelled the claim and i have to start again. i have to wait for a decision to see if they will give me the £130 back! blimey i am skint as it is.

i won't try and claim again untill i get the payment back

    thanks for your help

i have had an overdraft for ever. it is now £1500. I was hoping that someone had experience of overdrafts on this thread to advise me.

if i go all the way with abbey and they close my account will they expect the overdraft to be paid off there and then. the thing is i am claiming £1200, and i had no intentions of leaving it in my account as i owe my mum and dad some serious dosh which had mounted up over the years with them bailing me out for stuff.

    Any ideas anyone?

If there is any outstanding debt on the account in question they are entitled to offset any of the money claimed against this

    hi everyone

sorry if this has been posted before but i couldn't find it.

today i have been charged £265 for DD's and standing orders being paid when not enough money was in my account, i phoned them up and complained they said they could refund me £80, because i never had much money in my account i excepted.

can i still reclaim bank charges for the last 6 years..?

i also have an overdraft of £1700 will they stop this and what do they do if i don't have the £1700 right away..?

thanks for your help sorry if they seem like silly questions

    Hi there,
I'm in the process of claiming from Abbey and they cut off my overdraft more-or less straight away. I didn't have the money to pay it off so in the end they sent me a letter saying I had to send them back my card and cheque book and if I didn't do it within a couple of days they'd send someone round to get it and charge me £80 for the privelege!!! ANyway, rang them and said that they would get their money back when my claims case was resolved and not before. The next day I rang and was offered a third of my total claim. I accepted as part payment and it was just enough to pay off the overdraft!! Handy. ANyway, just as a word of warning, they may well cancel your overdraft and get shirty if you can't pay it off. I'd definiteyl get a parachute account and if poss get an overdraft on the new account so if necessary you can use that to pay off Abbey.

Keep going though, they'll give in eventually.
    So far:-

  • Hi everyone.
Started my son's claim end of Feb this year. He'd been charged £2500 for over 12 months in 2005 when he was unemployed. Phone calls from them at the time were harrassing to say the least. We sent off all letters but no other contact with them. Followed all suggestions on here and filed with MCL end of March. No AQ to complete but still paid the £100 and got court date for July23rd. Busy preparing court bundle this week so stressed. Was going to email them to ask/offer settlement before filing bundle today and hey presto a letter this morning saying Full payment by cheque is on it's way. Included also is the extra interest owed since claiming. Soooo pleased.
He hasn't gone over in his account since re-employed and will put this in an Isa. (Mum gets a bit of a bonus too for dealing with this and quite right too)
    :money:
Thanks to all who have offered help and support. Martin you are Brill.

Please keep your spirits up. You'll get a result in the end.

Hi Peter 191260,Ring Abbey and tell them that they didnt offer you the option to only pay 65% of the charge so, you cannot settle for less than 100%. I dont know if the court can award you more than this plus your costs. Abbey will say they have the right to a fee for any breaches, so your response should be 'tell me how much it costs for a breach of £1 for 2/3 days and an automated letter to be sent and I will happily pay this amount, I am objecting to the charge as its disproportinate to the cost of the breach and therefore illegal...' use their offer to start the negotiations, and remember they showed us no mercy when they applied these charges. Regards Sarah
thankyou sarah you have given me something to go on i have just written to the bank saying that as long as the payment they are offering is on top of the GOODWILL GESTURE !!! they have already given me i may accept the offer see what happens next dont you think this site is brill without the response frompeople here i wouldnt have had the know how or the guts to go this far time for the normal people to be counted
  • I sent the 1st letter along with the £10 fee and got my statements back in about a week so today I've just sent the 2nd letter!

Anyone had any dealings with the Abbey yet??

    Thanks

That's their complaint procedure. You only have to follow this and wait 8 weeks if you want to get the Financial Ombudsman involved. If not, don't be fobbed off, send another letter giving them 14 days to respond, and then file a court claim if they don't give you the desired reaction (which they most certainly won't). Read up on all processes in Martin's article on the Home Page.
