    Hi, I am currently claiming bank charges from Abbey and am stuck as they have played dirty and made me a LOW offer + payed it into my account without me even accepting it. Where do I go now?

    If its the Abbey, its probably 65% - thats their standard part payment.

    If it is a full and final settlement, write back to the bank, politely refusing it. Continue your claim.

    If it is a gesture of goodwill, write back to the bank, politely accepting it as a "part payment without prejudice". Continue your claim for the rest.

    Thanks for the reply. I had guessed that it would be prudent to turn the offer down - it is actually just 14% of my total claim. My concern is that the bank have already paid the money into my account.
    I have phoned them and made it clear I dont want it and they now say they cant take it back! I also made it clear that if they leave it in my account and I use any of it then it is NOT a sign of acceptance. Do you think this is right? I will of course tell them this in writing also.

    I have just sent the questinnaire back to my local county court against abbey. The abbey are probaly the worst of them all for drawing out the proccess. I had been offered 65% of my claim after taking them to court initially but they fob you off and make excuses so i decided to take it all the way. My advice is to hang in there and get most if not all of your money back.

  • Keep your chin up, I persevered with my Abbey claim it took nearly six months but I have been paid back in full!!!:j :T

    Totalled my charges and wrote to the Abbey asking them for my money back within 14 days. I received a letter back next day (this had been sent before receiving mine) saying they were having difficulties getting the info together! I rang them to ask if this letter was in reference to my request for my money, they replied no. However they said they had 8 weeks to reply to my request for money back. Is this just a delaying approach and should I push on to the next stage. Thanks in advance

    The letters saying that they are investigating and will reply within 8 weeks are acknowledgements of receipt and attempts to make you give up and go away. The 8 weeks only applies if you refer your claim to the Financial Ombudsman because you haven’t received a reply.

    Your first claim letter should give them 14 days to reply. If you have not received an acceptable reply by your deadline, send them the second “Letter Before Action” letter.

    At this point, you have to decide between referring your claim to the Financial Ombudsman and starting court proceedings.

    If you don't think that you could successfully handle a court claim, or can't afford the court fees and aren't eligible for fee relief, then the Financial Ombudsman is an alternative. It is free of charge and handles everything for you. They charge the bank involved £400 for each complaint they accept. However, they cannot award interest like a court. Their success rate is good but, if the Financial Ombudsman is unsuccessful or the settlement is unacceptable, you can still start court proceedings.<O:p</O:p


    If you threaten to refer your claim to the Financial Ombudsman, give them until 8 weeks from the date of your first letter to reply. However, if the reply either suggests that you now refer your claim to the Financial Ombudsman or says a definite no, then you can refer your claim to the Financial Ombudsman straight away. If you have not received any reply for the 8 weeks, you can then refer your claim to the Financial Ombudsman.

    If you threaten to start court proceedings, give them 14 days to reply. If you have not received an acceptable reply by your deadline, then start court proceedings on Money Claim Online.

    I and many others have received the exact same letter.

    I decided to give them the time they said they had to investigate only to find out 3 weeks later that they had decided to reject my claim despite it only being around the £200 mark.

    This is clearly a delaying tactic so would advise you send your next letter and stick to YOUR timetable.
