    i am now a little way down the road into claming back my bank charges from the Abbey. they have just taken away my overdraft facility and can not provide me with a reason. This is now making me overdrawn £500 without authorisation and further charges are being applied. As this is not my fault, can i freeze the account until my claim for £2500 plus has been resolved ? also can i claim for new charges that are being caused by them taking away the overdraft without reason. i think this is grossly unfair and am sure the ombudsman or court will be on my side as the bank are relentlessly causing me to make them more and more money.

    good advice would be appreciated as i'm extremely stressed.

    write back sayin thankyou and will accept the GOGW without predjudice (not much you can do anyhow) but will be continuing my claim for the remainder...........something along those lines.............it's not a big deal just shabbey's way of doing things.

  • Hi to everyone claiming against Abbey.
    I have just recieved all of my claim and more in interest.
    I went all the way to recieving a court date and then approx 2 weeks before the court date Abbey caved in and settled in full.
    My advice is keep going dont let their technical jargon intimidate you, you will get what you want as long as you stay confident! They will try anything-wouldn't you if you were having to pay upas much as they were? Best advice I can give is dont give up.

    Ok I have receieved a letter from Abbey today saying as a goodwill gesture they will refund me £245.00.As my claim is considerably more I am not happy to accept and leave it at that.Do I call them or do I write to them as it says it will be deposited within 10 working days.Snail mail really is that round here and I literally have 4 days to let them know one way or another.I am worried if my response does not reach them in time that the money will go into my account and the consencus will be that I have accepted this as settlement.

    In addition I sent a letter to yorksire bank on 11 April and have still received no response at all.I know they got my letter as they were quick to cash the cheque!

    Sorry if I am rambling it is all so confusing.

    Under the circumstances, ring them and then confirm it in writing.

    It is a goodwill payment anyway, but accept the £245 as a "part payment, without prejudice". By using these words, you can then legally continue your claim for the remainder.

    Congratulations!

    I am now just waiting on a court date, the judge has waived the requirement to submit an allocation questionnaire but I also think I have mis-placed my statements - would I need them for my court bundle? did you do a court bundle? Any advice gratefully received.

    I sent cheque and letter to Abbey about 2 weeks ago only for them to send me a letter today saying my account number that I had given was invalid. I phoned the number at the top of the letter to be told that they didn't deal with that sort of thing and would put me through. After over 20 mins on the phone and getting passed from department to department after explaining my problem I was finally put on hold then cut off!
    Phoned again to be told my account details were correct but I'd need to resubmit my letter as the department that dealt with that didn't have a contact number and only dealt with postal enquiries.
    Put the phone down feeling very angry and just abit of 'is this worth it?' but I suppose that is what they are probably hoping for.

    Hi Angelwillow,
    they are definately hoping that you will get disheartened and give up, so dont.
    Send your letter again and put in it their attitude wont do them any favors when they reach court as you have detailed their actions and will produce it as part of your court bundle (by the way, I dont know if you can actually do this, but I would add it to mine if it happened to me).
    This money was taken from your account illegally, as a penalty, when Abbey could only legally charge a fee to cover their costs.
    You wouldnt let anyone else do it, so why let them, please dont give in, it will be worth it in the end.

    We have sent off the statement with the details of the charges we want to claim back and the interest on top and have since received a letter from Abbey saying they have assigned a caseworker to 'look into' the situation and will get back to us. Yesterday we received another letter saying they were still looking into it but needed more time (why we don't know)! Has anyone else had this problem of them buying time or does anyone have any tips for how to stop them doing it?

    Your help would be greatly appreciated.
