    their defence is false and wont stand up i doubt, but if you want to accept so as not to prolong the issue, then do so if youre happy with that.
    I got an offer today of £2,200 from a claim of £2,500 and accepted, simply as i cant afford any more time spent chasing them and then flying from paris to a court case they wont attend!
    It's over now, but you must decide if you want to hold out for the full amount, which alot of people get. Bear in mind also that these cases are tying up the courts, so your appearance date may not be for a while?

    so your total claim is £3720 ?

    if abbey were to offer you full settlement of charges before court action then no you could not hold out for the interest as the courts would see this as being unreasonable and your claim would likley to be struck out.
    once you have submitted court proceedings papers you are entitled to claim interest at 8%...............the pre-estimate is what the whole process of us claiming is all about because the banks won't reveal what the true costs are.
    the defence is a standard one which everyone has received also, including mine.

    the choice of settlement is entirely upto you if you want to reject the offer then reply saying not thankyou and that i will be happy with £xxxx amount.

    no matter the amount abbey will always try for the small claims track.........because the last thing they want is for the fast track which automatically orders standard disclosure they will try to avoid this like the plague..........£8000 is not a bad thing i would go for it i've seen bigger and successful claims on the CAG site.

  • Hi everyone:o I am in the process of claiming charges from Abbey and have now got as far as taking Abbey to court. I was informed that I didn't have to fill an allocation questionaire in so have been waiting for the next step. I have now received a letter from Lincoln court which says......

    District Judge Toombs orders that this claim is stayed until 18th June 2007 to enable the parties to attempt settlement.

    The letter also says that " On or before 2nd July 2007 one of the following steps must be taken:

    either
    the claimant must notify the court that the whole claim has been settled or
    the claimant or defendant must write to the court requesting an extension of the stay period, explaining the steps being taken towards settlement and identifying any mediator, expert, or other person helping with the process. The letter should confirm the agreement of all the other parties.

    all the parties must file a completed allocation questionaire at the court. Where a settlement of some of the issues in dispute has been reached, a list of those issues should be attached to the completed questionaire.

    My question is do I sit tight and hope that Abbey write to me and offer me a settlement (hopefully the full amount) by the 18th or do "I" contact them now either by phone/letter or even email to attempt settlement?

    I would think with this letter they would write to you, however they are wll known as you can see from this thread for delaying things as long as possible.

    From my own experience, it was one week before my allocation document had to be in before they contacted me with an offer, which was 50%. We settled 2 days later for 100%.

  • You may be interested to know that having been offered a part payment before a court date was issued, i phoned abbey to reject the ammount and try to settle higher.I was told that the letter was a standard reply offering 65% of the claim ammount.I was told that I could either see the claim go through the court or write a letter asking for more.I was advised that the going rate for this approach was 80% of the claim ammount. So if you get a similar letter from them and don't want to go to court you could consider this option!
  • Thanks Sarah. I've read many threads on Martins website which have been very helpful and has encouraged me to carry on and also to help friends to claim their charges back from various banks etc so a bit more patience and sitting on my hands wont do me any further harm. Many thanks :)

  • I am trying to reclaim over £2,500.00 from Abbey, they have sent letters back stating they are looking into my claim, so I responded saying that they had a week to go and then I would go to court stage. They credited my account with £135.00 and then wrote to me few days later to advise me. I
    had not noticed this in my account and now need to send them a letter to tell them that I accept the part payment but will still be actioning for the remainder of the money - but I can't find a part acceptance letter. Can anyone advise me where to look please?

    Hi,
    is there anyone who can give us some advice? I have recieved a letter from the court today explaining my case has been transferred to my local area. ABBEY are defending with their account terms and conditions. I have also recieved a letter from ABBEY today, dated the 08.06.07 which acknowledges that I am unhappy with the charges incurred and as a gesture of goodwill they have placed £135.00 into my account- my claim is for £1213.00!
    Obviously, I am not prepared to accept this but it is already in my account, what do I do?:confused:
