  • Hi, I have recently tried reclaiming my bank charges from Abbey. The first response I got from them after about a week was a letter saying that they were busy and they would contact me in four weeks.. Ok so they may be busy. Then the next letter I got almost 4 weeks later was that they were looking in to my case and would be in touch again in another 4 weeks. Thinking that this was just a ploy to keep me waiting, after a further 2 weeks I sent the letter that gives them the option to pay with in 14 days at a reduced rate. To which I got a reply from them saying bthat they had looked in to my case and that the bank charges were applied correctly and that they were not going to refund any charges. etc etc. and if I didn't like it I should go to their complaints dept. or the financial ombudsman. (this is just the highlights of the letter) My question is what do I do from here?

    They did the same to me. I commenced court proceedings for the rest last fri. Go for it!! Good luck

    I successfully claimed £40 from Capital 1, I managed to escape the stage of asking for charges because I had all my statments anyway. BUT. Abbey have replied and the data they have given me is like the Da Vinci Code, it doesn;t make sense AT ALL!!:confused:

    1. They didn't even send me up-to-date lists, it only goes up to Mar/06!
    2. I don't understand why they've given me a print out of transactions from 2003 - 2004 (some of which include just ATM use) The statement says ***end of account at the bottom*** why haven't they given me up to date ones?:mad:
    3. i really really don't understand the rubbish they've sent me and it's really putting me off. Can someone please help me step by step with what this means?:confused:

  • I know this question is nothing to do with what you asked, but what way did the statements come when abbey sent them to you? I was under the impression they would just give me a list, but its as if they just gave me a pile of scatty rubbish! It doesn't make sense because they didn't even give me up to date info (up to March 06). I'm sure I could figure out what the abreviations mean, its just that they gave me 2 lists of stuff and I don't have a clue which is important. Sorry for butting in on your question, I was just hoping a fellow Abbey customer could give me some advice.;)

    does anyone know a number i can phone or email to ask if they would offer a settlement, i'm due in court August 14th, this has been going on since the end of january, and so i'm not a happy bunny....just wish it was all over!!!!

    Hi Miss Bonkers

    They always stall, and they have always so far offered to settle at the last minute. You can request the court strike out the defense on the grounds that they have no real intention of defending.

    A previous poster on this thread has done it successfuly and how to do can be found on the consumer action group website. It even has spreadsheets to form as part of your evidence.

    The abbey are just hoping you dont want to go to court and that you will accept whatever crumbs they offer you, and as I always say they didnt reduce the charges by 50% why should you accept only 50% of them back?

    Sit tight and dont let them get to you

    Congratulations!

    I am now just waiting on a court date, the judge has waived the requirement to submit an allocation questionnaire but I also think I have mis-placed my statements - would I need them for my court bundle? did you do a court bundle? Any advice gratefully received.

    I personally did not have to do a court bundle as such I still complied it although the judge said it would not be necessary. I do not think that was standard practice everyone else seems to have had to do one. But if you do one you will need your statements. If your account is still active you could try getting them on-line.

    I emailed them and told them they didnt charge me 50% of the fees so I cant accept 50% as a settlement.
    There response was they have a right to charge the fee, and I said I am happy to pay the fee just tell me the breakdown of what its made up of ie automated letter 50p, stamp 30p envelope 5p, human intervention at 5.00 per hour pro rata for 10 minutes work and then they can refund me the difference.
    At this point they decided that they would settle 100% without liabilty, and I said ok.

    the guys name was alan squires and if you do a search on the forums you should be able to find his email address but your letter probably has someones email on it as well.

    I rang today and accepted their goodwill gesture as part settlement for my claim without prejuidice.They forwarded me to stage 2 whatever that is I spoke to a really nice lady on the phone she said I was the only person today who hadnt sworn down the phone at her.
    So I am awaiting stage 2 documents - still unsure really what this entails.
