I originally received a response to my first letter asking for my money back stating that abbey were looking in to it and I should get a response within 4weeks but if they were not in a position to respond by then they would write to me again - I took it to stage 2 and got another letter saying as previously stated they were looking in to it and needed more time - 4 weeks or would write if needed more time - started the claim online - Tuesday was my day to get my money back £2500 but today the status has changed to acknowledged - disappointed. Does anyone know how the abbey settle ? as in I owed them £3400 for an acount which has been closed and passed to a debt collection agency which I am paying back at about £5 a month - will I get a cheque or will they knock it off my debt (if I am successful ) ??

hiya i have a mcol against abbey currently at acknowledge stage with them got till 5 july bout a day or to after it had been served noticed i had made a mistake with charges and interest on mcol form so rang mcol had to fill out a n224 n1 forms so i have to re-issue then yesterday had those forms back mcol saying didnt fill all of the amended particulars ahhhhh:(.So what i would like to know is it worth me ringing abbey to see if they want to settle out of any court my claim is £1570.99 but would take £1500.00 then give them couple days to think it over and if not then i would carry on fill out new forms so i could re-issue proceedings.Any advice would be great thanks.0

Started claim against Abbey in December last year asking for statements.
In February claimed £3390 plus interest £844.28 Total £4234.28
Received standard letters asking for time to investigate but just followed advice from Martin on time scale to follow.
Next letter to them in March telling them I would take them to court if they did not pay out.
They offered £500 to settle but just kept going.
Started court proceeding's end March. Cost £120
Got response that they were defending the claim beginning April asked for all details again £3390 plus newly calculated interest £899.36 Total £4289.36
Received letter from court in May asking for court bundle to be sent and copy to Abbey.
Two weeks later Abbey rang and made a settlement offer of £3000 refused, they rang back next day and finally settled on £4000.
Claimed £4289.36 received £4500 very happy.
Just keep the faith

Hi you need to go to money claim online and file the court action there. the original MSE posting on how to reclaim the charges should tell you how.

originally claimed £5,017 got a letter today(14/6/07) saying as a gesture of goodwill they would refund me £1,168 which has been deposited into my account want to claim whole amount (am i being too greedy?) what is next step help0

Taken, everyones advice, moving to stage 2, after receiving a stalling letter from Abbey. sending letter tomorrow giving them another 14 days before starting court action. your not being too greedy at all, write back to them and tell them you will accept this as a part payment of the whole amount and that you will be commencing court proceedings to claim the rest!!
