    65% personal claim is standard from abbey. I received my offer for this yesterday 11th june which I have declined. They will also put in a defence, . Take it further and get all your money back.
  • I have received a letter from Abbey offering me 65% of my claim. My claim was for charges plus interest but less £860 that they had already credited to my account - total £3050.63. The letter states they will pay me £1982.91;

    "subject to your having received any refunds or goodwill payments in respect of sums claimed."

    Does this mean that if I were to accept this I will receive £1982.91 or will I receive this amount less the £860 already paid?

    Can anyone help please????

    Are you sure that it doesn't say, " ... subject to your not having received ... "?

    Abbey have just offered me 65% of my claim. They said they have to charge me something for going overdrawn and I see where they're coming from.

    If I didn't accept and it went to court, would the courts agree with this and order them to pay only part of my claim?

    Also, I have claimed interest but that was when I filled the claim. Should I add more interest on from when the claim was made?

    the court may award the whole lot or they could deduct some for each charge figures in the region of £2.50-£4.00 per charge have been mentioned before.
    what you need to do is work out if accepting abbey's offer of 65% would be more beneficial to you or if it is worth taking the risk in the court.although i would say if you decided on the court route i would suspect abbey to settle in full before it reaches that stage.
    as for the interest re-calculate it using the calculator on the day before court or the time you decide to settle with abbey,whichever you decide

    Abbey are offering everyone 65%. It is nothing more than an attempt to take some of your charges from you for a second time!

    Does they mean that their actual costs for automatically administering a overdraft default are 35% of what they charge? I think not. 3.5% is probably closer to the mark.

    As far as the courts are concerned, as they haven't provided an exact breakdown, the whole charge is unlawful.

    When you file the court claim, you will need to re-calculate the 8% per year statutory interest, using the online calculator, up to the day you file the claim. You aren’t legally entitled to the interest on the charges unless it is awarded by a judge, but it can be used as a bargaining chip.

    I just wondered if anyone here has got their Data Protection Act info from Abbey. I don't want to reclaim bank charges but I need to know what transactions have occured on my Mums bank account (she has Alzheimers and I have been given a Short Order from the Court of Protection to deal with her finances). I am getting bills from the council to pay them for her care charges but cannot get thw DWP or DLA to advise on what she has received from them over the last two years to ensure that she is not paying too much for her care from her own money. I went into Abbey and they can only give me backdated statements to November '06. I thought that O might be able to get the information I need if I apply to them under the DPA for all they have on her.

    I really just wanted to know if the information you get from them details every transaction that has taken place and a name for the transaction - i.e. would it say Bank Credit £xx.xx from DWP or DLA and the date that the transaction took place.

    Sorry for the ramble but I just can't seem to get the info I need from any of the agencies involved or the bank themselves and I really don't want to pay out what the council have asked for as I am sure that it is too much!!

  • I have lodged my claim with Moneyclaim online, and have today received an offer from Abbey. They had already payed me £700 goodwill payment before I whent the court route.With the payment accounted for my claim is £2,900 plus £700 interest and £120 court fee. They have offered me £2,500 to drop charges. They have sent me a copy of their defence that states,
    They seem to be stating the fact that we have overdrawn our Overdraft as a point of defence.
    They deny that I can claim for £700 interest at all.
    They claim, fees are a pre-estimate of damage suffered by themeselves.
    Can someone give me some guidance on these points? and should I accept their offer and save a Court case?
    Any advise asap would be appreciated
