just about got sick of waiting for abbey now, last called them on 26 april and basically got told thousands in the queue and would take up to eight weeks to even look at. sent my first original letter in nov 06. haven't really got the £80 for the mcol fee and after seeing martin n tv about two weeks back after that stupid judge took the banks side in a case, i've now made a complaint toi the ombudsman instead. called on 08450801800 told them a few details and they sent me a complaint form the very next day, i filled it in and posted it same day. ill keep you informed of the outcome. by the way has anyone else gone this route would like to hear about it.ladyknight:grouphug:0

just had a reply from the court saying abbey are defending my claim what do i need information wise if they go all the way and i have to prove in court.they are obviously going to say i manage my account badly to have the charges imposed in the first place, but thats not the issue is it the amount they charge is illegal isnt it someone put me right coz i dont want to lose at this late stage HELP:0

I have gone the Ombudsman way as Abbey closed my account when I claimed back the charges. I did it in March and I am still awaiting the outcome, although the ombudsman have acknowledged they have recieved my complaint.
and finally - am I the only money saver offering these people the benefit of my wisdom????? surely there must be others who can enlighten us with their experiences of claiming against Abbey :-)

does anyone else have any email addresses for people at abbey, tryed alan squires but no reply, tryed phoning them but just get the answer phone, not surprising realy!0

I have used moneyclaim to claim back £100 in charges. Abbey have issued a defence. Has anyone else been through this stage??
Getting really nervous now. Anyone won as much as that back and how far did they go??0 -

Managing an account badly isn't an offence. Charging those who do an unlawfully high amount is. Well, strictly speaking, it isn't an offence either, but you know what I mean. In fact, if the banks solicitors put anything like that in the text of their defence, any judge would (almost literally!) throw it straight back at them.
The next step is to start getting your court bundle up together. This is basically three copies of everything you already have: your list of charges, your letters to the bank and any letters from the bank. Depending on the actual defence, you will need some other more legal documents. Please read the Court Bundle Checklist thread.
The bank’s solicitors won’t turn up. They daren’t. The last thing they want is to have to answer some potentially very expensive questions, such as just how little it does cost them to administer a late payment, overdraft, etc. However, this doesn’t mean that you “win” automatically. You still have to prove to the judge that you are due your charges back.

If I recall correctly, this wont go to the small claim court as its over 5k. This means it goes to a bigger court.
I suggest that you go and have a look at the Consumer Action Group website and get posting there as well, there are many different experiences and someone will be able to assist.
They also have a 'buddy' system so that if someone goes to court, someone who has also been to court and has experienced this will go along to support you.
You may find that as this is over 5k they wont want it to a bigger court as the ruling could be used as a precedent against them. I think there are also cost implications if you lose, but I am not entirely sure, so please check it out on the CAG site.
Maybe one of this threads moderators can help advise you, because this is a big claim and it needs to be right as the outcome could affect all of us!

It takes 1 week for them to receive the cheque from their trust company and then however long it takes to clear a cheque in your bank once they deposit it. I'm kicking off with them now as my allocation questionairre is due in before the 7 days it takes for a cheque to clear in my name. I just want to pick the cash up from the local branch and close the account for good.0

I have been trying to claim my personal bank charges from the Abbey, I have got to the stage where I am taking them to court. They have written to me offering 65% this does not include court fees. :j It looks like I will be taking the offer BUT
I had a business account with the Abbey and asked for statements. I have received statements but they are not showing any costs/charges, the only thing it shows is 'over cash' and 'int debit and 'unauth o/d fee''. I have rang the Abbey and they couldn't help, they couldn't work out what 'over cash' meant. Could anyone help me as know I paid a lot of bank charges in this account and I want to reclaim them back.0
