    I Started My Claim With Abbey Back In Jan 07, Recieved A Gogw Of £960 In April (total Amount Was Over £2000), I Sent A Reply Saying I Will Accept This As Part Payment And Seek To Get The Rest.

    I Then Had That Standard Letter Saying It Will Be 4 Weeks, Maybe 8 Weeks To Resolve. I Decided To Wait As I Dont Have The Money For Court And The 8 Week Period Is Up Next Tuesday.

    Has Any1 Been Successful In Obtaining The Rest After Accepting Gogw As Part Payment????

    Quickest way to get any bank to respond is unfortunately to take it to court!

    Been following the process for some months now but getting to decision time!

    Wrote my first letter of claim to them 20th Feb 07. Got a reply, busy at the moment etc, will have to wait upto 4 weeks then 8weeks! Then the letter we are rejecting your claim because they have done no wrong.

    10th May lodged a claim on MCOL £2,787 plus intrest £732.47 TOTAL 3519.47

    They acknowledged and have submitted a standard looking 3 page defence.

    However they have written and now offered 65% £2,365.66 but no mention of my £120 court fee to get there.

    Their telephone numbers 0207 756 4306 and 0207 756 4398 are on voicemail.

    I think the offer is low, should I reject or accept?

    ***UPDATE*** I rang the main switchboard 0870 607 6000 and had a winge, they listened and were really helpful. Got thru to discuss it with Inga who asked what sum I was after. Looking at it I wanted 100% but was happy to start negotiation at half way between the two. I have received an email confirming offer at £3,000.
    THIS IS EXCELLENT AS ITS ALL MY CHARGES PLUS COURT COST. I'M REALLY HAPPY:j :j :j :j

    Personally I would reject or accept it as part payment without prejudice only. After all, you have gone to the trouble of filing a court claim, so the offer is a bit risible.

    Negotiating a better offer through Inga/Tanya

    Has anyone been succesfull in getting a better through contacting Inga at Abbey, what's the best tactic to use. I've been in discussion and tried to get the remainder £1,111.00 which is owed, they've already made a part payment of £600.00. I've tried starting at £1000 to get the ball rolling but they have said that is not commercially viable for abbey ,they've now put the correspondence on file. Oh well I'll stick to going to court, bring it on

    I hope someone can help me.

    I have wrote to Abbey twice now and they wrote back to me saying that they have credited my account with £150 as a gesture when infact I was claimming £1551.46 (inc.interest). I don't think this amount is fare!

    Is there anyone who has had this happened to them??? And is there another letter that I can send out to Abbey???

    Please, Please Help Me!!!

    Start court proceeding, that will get a bit more action out of them. Otehrwise, they will fob you off

    I filed a claim at my local county county in Bradford, Abbey have made 35% of my claim as goodwill gesture. I filed my case and abbey had until 18th June to enter a defence , today I have received the following:

    Notice that Acknowledgement of Service Has Been Filed

    The defendant filed an Acknowledgement of Service on 5 june 2007

    The defendant responded to the claim indicating an intention to defend all of the claim. The defendant has 28 days from the date of service of the claim form with particulars of claim, or of the particulars of claim, to file a defence.
    Can any please advise what I should do, prepare anything, or just wait for the next letter. What usually happens at this stage particularly with Abbey

    Any advice greatly appreciated.

    I would just continue with the procedure as detailed on here then see what happens, you will probably get more when they see the words 'court action'

    hi alonso i had my acknowledgement from abbey to they got till 5 july to respond i am going to wait to see what happens also had a letter from them looking into your complaint etc give us 4 weeks second 4 weeks they had hopefully they will admit my claim before the 28days are up
  • Hi,

    I posted the initial (template) letter to Abbey on 27th April requesting a refund of my bank charges and got the standard letter saying they are looking into it and will aim to reply within 14 days. Got another letter a few days ago saying their investigation is taking longer than expected and will contact me again as soon as they have information. How long should I wait & if I should chase them up, is there a template to a letter (if not, should I threaten them with legal action?).
