Im really worried now about my case. Wrote to Abbey 4 times over the past 6 months trying to claim back £325 + interest. I file with MCOL back in March 2007. They first acknowledged then defended on the 15/04/07. I got a letter from my local court on Friday saying your court date will be annocened soon & a letter with Abeys defence. In the letter they have crossed out the part where the allocated questionaire is to be filled and the words,
' the filling of an alloctaion questionaire will be dispensed with in this case unless the District Judge at the Court of Transfer orders otherwise'
To me this is translated into , the judge feels like Abbey are correct in putting in a defence & they case will be heard in court. I really dont want to go to court. If they do not settle, will it go against me if I don't turn up to give my side? I know I can't pull out now. Im getting married in November and can be doing without the extra stress & my hair will be grey soon :-( My 'futur husband' nags at me every week, telling me to drop the case (even though Natwest paid £610 out to him!)
Any help or Kind Words of assurement would be great.0 -
I've highlighted my statements and sent them with both first and second letters (threatening to take them to court) and have recieved a response, stating, 'Our research is taking longer than expected because we want to make sure a full investigation is done.... we will write to you again in four weeks.'
Do I wait? Or do I proceed with court action?0 -
can i ask way you sent the paperwork at this stage normaly you send it to the court?????????0

Thanks to the site i have followed your step by step guide to re-claiming my bank charges from the Abbey, letters and proof have been forwarded to the Abbey complaints department who have replied saying they were looking into my claim. I have recieved 2 letters from them saying due to the time limit they were still looking into my claim which has now gone over 2 months as the title say's do i sit tight or send them some sort of reminder, can anyone please advise me, one other thing my partner mentioned to me that she heard on the news a bank had been took to court and one the case, is this true and will it effect ant claims in the future, cheers.:beer:0

hi everyone,
i have recently sent my first letter to Abbey giving them 14 days which expires tomorow. i will then send my second letter giving them a final 14 days.
Question 1. i was just wondering if after the next 14 days would it be more effective to refer my case to the financial ombudsman or to the court?
Question 2. when, if any, would it be an appropriate time to call the bank and give them the chance to settle?
any help would be great.

Does anyone out there have an email address for the abbey that they actually respond to i have sent numerous emails and had absolutely no answers for 2 weeks. Thanks0

E-mail is not reliable or secure enough for this type of correspondence.The acquisition of wealth is no longer the driving force in my life.0

i have put a claim in against rbs and recieved a letter saying it will take them 6-8 weeks to decide due to the enormous amount of work involved now including interest my claim is £1478 compared to some this does not seem so enormous is this time frame justified or are they just hoping I'll give up and forget in that timeKondo'ed 76 items from wardrobe, 4 carrier bags of books0

Hi, I am at the stage where I have sent the second letter (I send them all special delivery), to Abbey, I recieved a reply on Saturday saying thank you for my patience, they are looking into my complaint and they would get in touch in 4 weeks. Do I just sit tight and wait or do I write to them again? They have already refunded me my £10 for the statements for taking so long to get them to me. I am in no rush, I just like to know where I stand, and dont want to be 'fobbed' off, I am happy to wait, if its 4 weeks it actually takes, I do understand that they are probably under a huge demand at the moment.
Any advice would br great!!!!
