Not to sure which way to go with this:-
Sent 1st letter - Got statements
Sent 2nd letter - Got the investigating reply
Sent 3rd letter - They deposited £430 a day later received letter about gesture of goodwill of £508
Sent 4th letter accepting refund without prejudice and informing them they have 7 days to deposit the remainder of the money otherwise I will take them to court.
TODAY - received a letter telling me they have made progress in looking in to the complaint but if I do not want to wait any longer I can go to the Financial Ombudsman Service now.
Do I just wait for my 7 days and then start my claim or is there something I should do.
Any advice would be welcomed.
Thanks
Claiming for £4,482.50
Received £430 GOGW (Although they sent a letter telling me it would be for £508)!!!
You can wait the 7 days and hope you are refunded in full ( it may happen) or you can go to court now for the remainder of your claim. You have given them ample oppertunity to settle and I would not give them any more than the 7 days after that though. Good luck0 -
Hi there folks!
I have received my court date now for the 5th September but have to have my defence in for the 24th June!
September seems like a lifetime away as i have plans to get my central heating fixed with the money as i havent had any since last august (but thats another story!)
Things is, should i write to Abbey now saying that i am willing to accept a certain amount or should i do nothing? As i seem to recall that they have a habit of contacting you on the run up to the court date and offering to settle. thing is, they'll probably wait until the eleventh hour!
Any advice please?
Many thanks!0 -
P.S. does anybody know the right thread to get some advice about claiming "admin fees" of £40 a go from GE Money??!
I have sent off the first letter and they have fobbed me off, can i claim for these type of fees? as i am paying off £50 a month, then a month after they are whacking on a £40 "admin fee" so i am getting nowhere paying off this debt.
The annoying things is, i got 2 months behind with a loan payment because i was on long term sick and my Payment protection wouldnt pay out!!
Dont waste your money people on payment protection as its not worth the paper its written on!!
I am paying the loan amount a month still, but i cant get rid of the 2 months arrears when they keep whacking on charges each month!!
Very angry!!!0 -
Brickie it may be worth asking them to add the arrears back into the loan, I realise this doesnt work out cheaper in the long run but it stops you accruing charges. Write a complaint letter to them and then when they say there justified blah blah blah, write to the ombudsman. I havent done this myself but, you may be able to use the ombudsman to get a breakdown of the admin fee or they may settle up with you before the ombudsman asks for this.
Good luck and keep us posted

I started writing to the Abbey back in November so its taken 6 months to get it all sorted out.
When my claim was referred from MCOL to my local court I telephoned my local court to find out what was happening. I was told that my case had been passed to the district judge and it would take 4-6 weeks before I would be informed of when my court date would be. I got a letter on 4th May informing me a court date had been set for 5th June and I had been allocated an hour for my case to be heard.
You have to submit a court bundle no later than 14 days before court date so I was cutting it fine to get mine submitted. I just copied all the letters that I had sent the Abbey, all the letters that the Abbey had sent me and then copied the statements which showed evidence of all the charges Abbey had taken from my account. It took me a good couple of hours to do this and get it collated as you have to do two copies - one for the court and one to be sent to Abbey.
I would give the court a call in a couple of weeks to see what is happening. You never know, Abbey might write to you and pay up before you get a date!
Good luck
thanks for that!
Received my date yesterday for 5th september but asking for the court bundle for the 24th june! After what you went through i found the date of when you had to have the court bundle in and the actual date of the hearing quite an unusual time scale!
Strange, knowing abbey, they probably leave settling until the eleventh hour!!
What d'ya think?
Any advice? Is there anything i can do to get this settled quicker?0 -

thanks sarah, i'm not sure but i think they might have done this already, i'll have to call them, i received a letter yesterday saying the following:
"In accordance with the terms and conditions of your mortgage / credit agreement, your monthly instalment has changed to reflect the change in base rate. We will also be making a further change to your monthly instalment to include repayment of £288.67 (i dont know where they got this figure from!!) which has been added to your account. Your new monthly instalment will be £137.63 with effect from 22nd june 2007."
I dont think this is to include my arrears as they would've worded it as arrears wouldnt they?
I think i'd better call them tomorrow.....hate doing so as i take ages to get through and its on a national rate number!! I should be claiming for the phone calls i make!!0 -
have you tried them on saynoto0870 ? or googled the premium rate number as sometimes it gives alternative numbers associated with the premium rate number.
I hate calling them, I hate paying for people to keep me on hold for ages.
Perhaps you should send them an 'admin' bill for all the calls your having to make, lol
once again good luckSarah0 -

Thanks Stephen Leak & Kurt_Hamster for the links & advice!
Kimmywal - glad I'm not the only one having trouble understanding the random bits of paper they seem to be sending out at the moment...grrr.
Trying to figure all of this out is harder than the Uni course I'm doing at the moment.......maybe I should change to Law? Anyway....the bear will keep plodding!
Thanks guys.0 -
Hello,
I have been sending the template letters to Abbey Nat. and have received the usual brush offs. However recently I got a letter stating that they have transferred £700 into my account and they consider the matter closed. This would be fine, but the total claim is for nearly £7000.
How can I proceed?
Many thanks for any advice.0
