  • Just got a reply back from them offering £1088.00( one thousand pounds) goodwill gesture for a £21k claim. obviously am send them a refusal letter . This was after a wait of 8 weeks.

    My letter says "District Judge Grand has considered the statements of case and allocation questionnaires filed and allocated the claim to the small claims track. Before the claim is listed for hearing the judge has ordered that a preliminary hearing should take place....."

    Has anyone seen this before or can help me on this matter

    Hello Busybearing, I have had the same thing with Abbey, first statement which is clear, the second I cant make head or tail of, think I will take the advice and pop into local branch for an explanation or CAB :confused:

    It's something that is becoming increasingly common, and in a lot of cases can speed up the bank's willingness to settle early.

    For those people who have submitted a claim through the local county court in person, how long was it before you heard from the court. I've made a blunder , I handed my paperwork/N1 form on the 24th May and didn't get a receipt or anything , I'm going to give it 10 working days before I get in touch with the court.

    did you pay the fee?.. depending on the amout you'r claiming i.e. £120/ £250

    I showed my tax credit document and the girl checked all the paperwork and said it was all fine and I should hear from them in 5/10 days.

    I did that on 24th and on the 25th recieved an offer of £600.00 (claiming £1711.00) wrote back to say I'll accept as part payment and will continue through the courts. I'm waiting for confirmation through the courts so I can tell them to amend my claim.

    ok.............it depends on how busy your local court is..................mine took just over a week to be deemed as served............you will hear from them.

    Not to sure which way to go with this:-

    Sent 1st letter - Got statements
    Sent 2nd letter - Got the investigating reply
    Sent 3rd letter - They deposited £430 a day later received letter about gesture of goodwill of £508
    Sent 4th letter accepting refund without prejudice and informing them they have 7 days to deposit the remainder of the money otherwise I will take them to court.

    TODAY - received a letter telling me they have made progress in looking in to the complaint but if I do not want to wait any longer I can go to the Financial Ombudsman Service now.

    Do I just wait for my 7 days and then start my claim or is there something I should do.

    Any advice would be welcomed.

    hiya mate i recieved a letter from the court saying abbey have to reply to them by 13th june with there defence i applied my mcol on the 24th may if abbey dont reply i will have to check up on the mcol site to see what i have to do next so i live in hope good luck with your claim its nice to see everyone sticking together thank god for this site
