    Hi just filling out the mcol form and it ask if i want to claim the intrest also do i tick yes if so up pops a box with this in it The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from {date when the money became owed to you} to {the date you are issuing the claim} of £ {put the amount} and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of {enter the daily rate of interest}. Do i just copy and past this into my Particulars of claim box and what is the daily rate of intrest.

  • Can anyone help me i am in the process of court proceedings and ABBEY have offered a defence so the matter has now been refered to my local court.
    we have been waiting for this questionair and a court date but the court has now written to me saying i have not paid £100 realocation fee we where not aware that we needed to pay anymore money has we have already paid £120. can anyone give me any advice????

    yes it's correct if your claim is over a certain amount then a fee of £100 is payable which you get back when your claim is succsefull you pay the fee when you complete the form and hand/send it in.

    Dear Paddy O Moron,

    Shabbey always defend and as far as I am aware, negotiate at the last minute, I think to try and get you to accept a smaller amount than what you are claiming. They settled the full, when I emailed them and said I wouldnt be accepting their offer that started the negotiating.

    this is my first time and i need some help please
    i have two questions.
    1.i am at the stage of taking Abbey to court and have received a letter of defence,the only problem is that the court is in northampton and i live in bolton.
    can i change the court venue?
    2.i made a school boy error in sending the original statements with my letter back to Abbey when starting my claim.
    can i continue without them?

    don't waste your time they will not settle until the last minute, you may get a 50% offer when they file their defence, personally I would reject it and carry on with your claim

    You are taking the bank to court, you can't expect to turn up at court and say I made a mistake or your case will be thrown out.

    You can amend your claim on MCOL by paying £35, phone them up and find out what you should do.
  • Hi I have been pursuing Abbey for my bank charges for some time (it took them eight months to send my statements) wrote my first letter in March requesting just over £2000 plus interest. They responded with the standard letter of we are looking into it and we will reply within 4 weeks. I decided to allow them this time but then they wrote again (to my husband only, its a joint account but it was me that raised the complaint) they said they wanted a further 4 weeks. At this point I sent the second letter giving them 2 weeks or I would go to court. They chose to ignore this so I went ahead and filed a claim through the court (paid £120). They acknowledged the claim after 1 week so I am waiting for them to file a defence but yesterday they credited £545 to my account with no notification or acceptance from me of this amount.
    What do I do now?
