Hi This is my first post so please bear with me.
I have begun the process of reclaiming charges using the letter templates. Abbey have tried various stalling technique's the latest being that they have sent a duplicate list of charges but only up to december 2003 and i have just recieved a letter saying (from a different department)they are paying £380 into my account as a sign of good faith.My calculations so far already amount to £3700.I have sent a letter asking for the missing information but have not recieved anything-they are impossible to reach on the phone.
What do i do now? can any body help0 -

Put everything in writing. Continue with the timeline of your chosen claiming path and don't let up on them.

Just a quick question to all you experts lol I am just about to send my LBA to Abbey giving them 14 days before I file MCOL. I have just printed off another summary of charges inc interest and the interest has obviously accumlated very slightly since I last sent the initial request for a refund, so should I just amend the amount of interest and total that I am now claiming or should I leave it as the original figure?! Hope that makes sense.

Hi guys, claiming with tha abbey myself at the mo. They sent every single one of my 6 years statements in a seperate envelope bless em!! post man must've wondered what on earth was going on . They are currently stating 8 weeks for any charges claim depending on circumstances but 8 weeks is the max. when i referred them to my 14 days in the letter they asked to be given the 8weeks then any court action would be fine! (think the choice is mine not theirs!!)
Claiming £1650 but they do seem to be employing delaying tactics right now! keep trying to phone, i got through twice and both members of staff i spoke to said directly that the charges were excessive for how my account had been utilised, have kept the names for use in court if necessary!!!

My letter says "District Judge Grand has considered the statements of case and allocation questionnaires filed and allocated the claim to the small claims track. Before the claim is listed for hearing the judge has ordered that a preliminary hearing should take place....."
Has anyone seen this before or can help me on this matter

Hi! This site is completely brilliant I would never have had the confidence to take Abbey to court without it but I need a bit of help. I have filed the claim with moneyclaim now and received a copy of the defence that Abbey intends to defend with. What do I do now?
Also how likely is Abbey to close my current account after this i'm claiming just under £1000?

hiya all have done my mcol today claiming £1240 off abbey but i think i might have messed up on my interest i am also claiming off them on the mcol claim bit could anyone tell me would it matter or can i say if it goes court i made a mistake?0

I submitted my claim in person at the local county court but 5 days later I've received a letter from Abbey stating they've carried out a full investigation and they've offered my £600.00 as goodwill gesture, my claim is for £1711.00+interest (if I win in court). Do I just send a letter back stating I accept but without prejudice and will continue to claim for the full amount, when do I let the court know about this offer so they can amend what I'm asking for.
Is there a link to the best sort of letter to write at this stage.0 -
I've been thru the usual yes-you-did, no-I-didnt correspondence with Shabbey. Fed up with their obfuscation (now there's a word!), I filed a claim with MCOL, and subsequently was told that Abbey will defend the claim
On Thursday (May 31st) the case is due to be heard. Last week (Friday, May 25th), I received a letter from Shabbey setting out their defence. It was the usual stuff (I think) - I had been notified of the charges in advance, the charges were fair and represented the true cost to the Bank, etc etc.
2 questions:
1. Has anybody else had a letter like this?
2. Did Shabbey actually defend, and what was the result of the court hearing?
I may well be one of the few cases that Shabbey actually contest, in which case, I will report on how I got on - possibly Shabbey spotted a loophole in my claim (altho I am sure I followed Martin's templates to a T). Anything I learn will be shared with this site's users.
