I asked for my last six years account statements over the phone and gave them permission to deduct £10 from my account which they havn't done. The 40 days is now up and so far I have received copies of last years statements. Last week they sent another four years statements but in a strange, unintelligible format which seems to exclude details of charges. One year is still missing.
Have I been "done" by the Abbey and should I start again with a letter and cheque? Is their sending me statements evidence that I have requested them should I need to pursue this through the data protection people?
Anyone else experienced this?
You haven't actually made an official Subject Access Request. This has to be done in writing. Additionally you can't just ask for "6 years of statements".

Need help please!
I am claiming back (or trying to claim back!) over £14000 in charges without interest, Its over £18000 with interest- is is better to split the amount into 3 to go through the small claim court as they will then be unjder £5K or just go for the whole lot in one go?
Thanks

If you split ot into 3 claims then as you say it will keep each one below 5k and safegaurd you against costs. If you do this though, make sure you keep accurate records of each claim and don't mix them up. The courts will not look favourably on the claimant getting the figures wrong. Also make sure you have another account open as they will probably close your account when they see 3 claims on it.
Good luck.0 -

If you split the claim it could possibly be deemed to be an abuse of process as you are attempting to manoeuvre around the system.
Although the rules are different for larger amounts I'd recommend you claim for one amount.Hamsters have no tact and diplomacy, nor do they want any.0 -

I doubt they would see it as an abuse of the system rather a way of safeguarding yourself from possible court costs in the event your case was struck out in the event that you missed out details for whatever reason. The choice is yours!0 -
